RE: SUB 2008 -125 Coleman Family Division
Dear Mr. Coleman,
I have reviewed the above referenced plat. It may be signed when the following items are addressed:
(Each comment is followed by the appropriate provision from the Subdivision Ordinance, Chapter 14 of
the Code of Albemarle)
1. Health Department approval has been obtained. I have forwarded the soils work to the Health
Department for their review. [14 -310]
2. VDOT approval of entrance location. [ 14- 212(b) and 14 -316]
3. Revise the development right note (note number 7) to read: "Parcel C is assigned one development
rights and may not be further divided. The residue parcel is assigned 2 development rights and
may be further divided." [14- 302(a)(10)]
4. Note that this property is not located in an Agricultural Forestal District and is not located within a
drinking water reservoir. [14- 302(b)(7)].
5. Revised note number 4 to indicate that the front yard setback is 25 feet from internal streets and 75
feet from Harris Creek Road, Route 720. [14- 302(b)(8)]
6. Note on the plat "The streets in this subdivision may not meet the standards for acceptance into the
secondary system of state highways and will not be maintained by the Virginia Department of
Transportation of the County of Albemarle." [14- 303(n)]
7. Provide control points at 4 corners of the lot. [14- 303(s)]
8. Provide verification of family division [14 -211 and 212(A)]. For your use a copy of the family
division verification form is attached.
9. Add the following note to the plan: "No lot shown on this family subdivision plat may be sold or
conveyed to a person other than an eligible `member of the immediate family,' as that term is
defined in Chapter 14 of the Albemarle County Code, for a period of four (4) years from the date
of recordation of this plat except as authorized by Section 14- 212(A) of the Albemarle County
Code. If any lot created by the recordation of this plat is conveyed back to the grantor during the
four (4) year period, it shall be recombined with the parent lot within six (6) months after such
conveyance." [14- 212(d)]
10. Add a note stating "The existing and/or proposed right -of -way is of adequate width and horizontal
and vertical alignment to accommodate a travelway passable by ordinary passenger vehicles in all
but temporary extreme weather conditions, together with area adequate for maintenance of the
travelway as required by section 14 -412 of the Albemarle County Code." [14 -412]
11. Re -label "Existing 30' Access Esmt." As "Centerline of existing 30' Access Esmt" [14- 302(a)(4)]
12. As proposed, parcel C has inadequate frontage. It has only 151 feet of frontage on the public
street, Harris Creek Road, and only 116 feet of frontage on the private street approved to serve
parcel B (as shown on the plat signed 10/19/06). Frontage of 250 feet on a public street or 150
feet on a private street is required. [14 -400]
