V, Critical Slope Waiver Request Date received: 30 June 2008 (critical slope document date 24 June 2008) Date of Comment: 10 July 2008 The request for a waiver to develop on areas of critical slope for grading incorporated with the new construction proposed on TMP- 56H -AO was received on 30 June 2008. It should be noted that a critical slope waiver for this project was previously approved by the Planning Commission with the review of a preliminary plat (SUB- 2007 - 00037) that was withdrawn immediately prior to the applicant's "Final before Preliminary" submittal. Disturbances to critical slope areas have been slightly modified since the first waiver approval was granted. The engineering analysis of the request follows: Description of critical slope area and proposed disturbance: The critical slope area, within TMP 56H -A0, appears to be both natural slopes and man -made slopes created with the required improvements for Westhall Subdivision Phases 1 -4. The critical slope disturbances are typical for subdivision construction: single family residences, roads, stormwater facilities, and water and sanitary sewer lines. This plan also includes off -site work on TMP 56 -53 to upgrade the embankment of an existing farm pond to the proper standards for use as a SWM facility. "movement of soil and rock ": Proper slope construction, control of drainage, and vegetative stabilization with approved erosion control measures constructed within the standards of Virginia Erosion and Sedimentation Control Regulations will prevent any movement of soil. 2. "excessive stormwater run - off ": Stormwater runoff will be controlled by the drainage / Albemarle County Community Development Engineering Review comments Page 2 of 2 stormwater management plan required for this site. 3. "siltation of natural and roan -made bodies of water ": There is an existing stream located on the western half of the property. Inspection and bonding by the County will ensure siltation control during construction. Proper stabilization and maintenance will ensure long term stability. 4. "loss of aesthetic resource": This site is visible from the other previously approved sections of the Westhall Subdivision. It is also visible from other neighboring properties. It appears that the loss of aesthetic resources will be necessary with the proposed plan. 5. "septic effluent ": No septic systems or drainfields are proposed in this project. This site is accessible to the public sanitary sewer system. Based on the above review, there are no engineering concerns which prohibit the disturbance of the critical slopes as shown on the plans.
