We have reviewed this application and have several comments. These first comments relate only to
what was submitted the second set of comments is additional comments / recommendations.
1. General comment: please revise the application plan for transportation improvements to
clearly delineate the proposed phasing of improvements.
2. Proffer 1 A: Please revise the proffer to a) clarify the segment (begin & end) for these
improvements; b) clarify what is accomplishes "construction" and when dedication will occur;
and c) consider having the design of all roads to occur in this first phase.
3. Proffer 1 B: Please revise the proffer to clearly state when roads shall be COMPLETED and
what that means. We suggest language similar to Hollymead Town Center's which also
specifies when dedication shall occur including a date. The current language does not
address completion of construction at all and is not consistent with Zoning Ordinance
requirements. The proposed language relating to commencement appears to be too late in the
process. Current guidelines in the proffer policy generally recommend tying acts to a building
permit, not certificate of occupancy. It does not appear that the construction of Third Street is
included in phase 1 proffers.
4. Proffer 1 C: This language is unacceptable and is inconsistent with current Zoning Ordinance
requirements. We suggest that an overall landscape plan be approved and that installation of
landscaping may be phased as provided in the current Z.O. See Design Planner's
recommendations.
5. Proffer 14: Please substitute County Attorney's recommended language.
Additional Comments
1. Please be certain to consider the County's requirement for authorization from all property
owners for certain rezoning amendments, as you draft deed and covenant language. Absent a
provision for that approval, owners' authorization for substantive amendments may be difficult
in the future.
2. Please consider requesting waiver /modification to Section 4.15 sign regulations with this or a
future rezoning amendment.
3. Please revise the Code of Development to: a) provide for wireless facilities in accord with the
current Z.O.; b) provide for home occupation class B.
4. Please address the setback or build -to range. This is not clear and needs to be tied down on
the major external roads in particular. You may wish to make an exception to that requirement
for certain facilities such as a sewage pump station, provided the necessary streetscape can
still be provided.
5. Please address proposed changes to the building height.
6. Suggest that proffers that are up to the County's requesting something, such as the traffic
signal, be tied to some specific trigger such as a date, approval of a plan or building permit.
7. Proffer 6 and any other with similar language: Tie the requirement to approval of the first site
plan or plat and not to a time period AFTER that approval.
Change references / triggers from issuance of certificate of occupancy to issuance of building
permits.
