This letter is to notify you that the Zoning & Current Development Division of the Albemarle
County Department of Community Development has reviewed the above referenced subdivision
application, which cannot be approved as submitted. Below, staff has provided comments based
on the applicable sections from Chapter 14 of the Albemarle County Code. The following
comments are those that have been identified at this time. Additional comments or conditions
may be added or eliminated based on further review. [Each comment is preceded by the
applicable reference to the Albemarle County Code.]
Please note that the Zoning Administrator has determined that the Zoning Ordinance does not
allow a private well on one parcel to serve adjoining property. The exceptions are 1) a central or
public well and 2) an emergency situation in which a well fails and no onsite well is available for
an existing establishment. Therefore, the code requires each parcel to be served by an approved
septic system and well. Before the plat can be approved, the health department must approve the
proposed well and septic systems, and the approved plan must be shown on the plat.
1. [Sec. 14- 302A13] Proposed facilities. COMMENT: The plat must show both the
existing and proposed water and sewer improvements.
2. [Sec. 14- 309 -310] Soil evaluations and Health Director approval of individual private
wells and/or septic. COMMENT: Individual wells and septic system approval is
required prior to the approval of a subdivision. Provide soils information per this section.
3. [Sec. 14 -416] Individual private wells and septic systems. COMMENT: The proposed
new wells and drainfields must meet the requirements of this section and be approved by
the Director of Health. You must obtain health department approval of proposed well and
septic systems prior to the approval of this subdivision.
4. [Sec. 14- 302A101 Right of further division of proposed lots. COMMENT: The plat shall
contain the note provided in this section verbatim.
5. [Sec. 14- 302B51 Zoning Classification. COMMENT: Provide zoning of subject
property.
6. [Sec. 14- 302B7] Reservoir watershed/ agricultural forestal district. COMMENT:
Provide information as required by this section.
7. [Sec. 14- 302B8] Yards. COMMENT: Provide/label yard requirements as required by
this section.
8. [Sec. 14- 302B9] Floodplain. COMMENT: Confirm that this property is not within a
floodplain.
9. [Sec. 14 -303N] Statement pertaining to private streets. COMMENT: Provide required
note per this section.
10. [Sec. 14 -303Q] Water supply. COMMENT: Provide required note per this section.
11. [Sec. 14 -303S] Control points. COMMENT: Provide required control points per this
section.
12. [Sec. 14 -316] Approval of entrance onto public streets. COMMENT: VDOT approval of
proposed new private street is required.
13. [Sec. 14 -317] Instrument evidencing maintenance of certain improvements.
COMMENT: A private street maintenance agreement is required by the ordinance, and
must be approved by the Albemarle County Attorney prior to final subdivision approval.
Please submit a maintenance agreement to the Community Development office to begin

14. [Sec. 14 -412] Standards for private streets only. COMMENT: The proposed new
private street must meet all of the requirements of this section. Provide note as required
by 14- 412(A)(4).
15. [Sec. 14 -303E] Dimension standards and information on all lots, streets, alleys,
easements, and shared driveways. COMMENT: Relabel "New 30' Access Easment" as
"30' Private Street Easement."
