Subject: SDP 06 -041 Briarwood, Phases 1A- 1,1B -1, and 8 Final Site Plan
The Albemarle County Division of Zoning and Community Development: Zoning and Planning
Review has reviewed the submitted final site plan referenced above. This final site plan is subject
to the conditions of Preliminary Site Plan SDP - 2005 -055. The Final Site Plan will not be
approved/signed until the following conditions have been satisfied:
1. [18.32.6] The final site plan, in addition to reflecting all the requirements of 32.5.6
(preliminary site plan requirements), must also reflect all final site plan requirements.
2. [Proffer #1] You must establish open space proportional to the aggregate number of
dwelling units shown on this site plan. Open space must be labeled, dimensioned by
metes & bounds including area and set apart on the site plan. While open space is labeled,
the specific areas are not delineated. Please delineate the open space areas on the plan.
Also, since mets and bounds are not provided on the plan, please provide a copy of the
record plat to which you refer in your responses to comments.
3. [Proffer #6] This proffer limits areas of disturbance to those needed for structures,
utilities, pedestrian ways, recreation areas, roads and other improvements. All other areas
must remain in their natural states. Please provide clarify tree protection fencing on the
plan, since it is not currently labeled or included in a legend.
4. [Proffer #11] This proffer requires that 25 for sale townhouses are affordable and the
owner of the property must enter into a contract with the county to ensure that this
happens. Ron White, Director of Housing does not have any evidence that you have
contacted him. Please contact Mr. White at 296 -5839 to begin this paperwork. Also,
please add the proffer #11 reference note that is on Sheet 1 to Sheet 4 as well, and
graphically differentiate on the plan which lots are reserved for affordable housing. This
may be done in any reasonable manner including shading, a symbol (with legend), etc...
5. [18.4.7.4] Open Space shall be protected by legal arrangements to ensure its maintenance
and preservation. Please submit covenants meeting the requirements of Section 14 -313 of
the Subdivision Ordinance. These agreements are subject to County Attorney review and
approval. Again, open space must be labeled, dimensioned by metes & bounds including
area and set apart on the site plan. If mets and bounds are/have been provided on the
record plat, please provide a copy. Again, among other requirements, you will be
required to plat these tracts of open space prior to approval of the final site plan.
6. [ 18.4.16.2] Thank you for your email and August Stn letter addressing the proposed third
tot lot. However, in order to properly review this, it must be submitted as part of the final
site plan. Please include the revised plans showing the proposed third tot lot in your

resubmittal. Also, please update the schedule on the cover sheet. As a reminder,
equipment required for each tot lot is as follows:
One (1) swing (four (4) seats)
One (1) slide
Two (2) climbers
One (1) buckabout or whirl
Two (2) benches
Each tot lot shall consist of at least 2,000 square feet and shall be fenced
Show tot lot equipment details and fencing on the plan. Also, state what kind of ground
cover will be used.
7. [18.32.5.6.o] Indicate (by labeling) all areas to be dedicated or reserved for public use.
Also please add to General Note #4 that all public streets shall be dedicated to public use,
and, add to General Note #5 that easements shall be dedicated to Albemarle County
Service Authority.
8. [ 18.32.7.2.8] In addition to the sidewalks required by Proffer #5, per the code and per the
conditional approval of the preliminary site plan (evidenced by letter from Yadira
Amarante of our office dated August 8, 2005), you must provide sidewalks along both or
one side of each private and or public road which serves each townhouse or duplex unit.
9. [Comment] Please be consistent when identifying the open space areas; the labeling of
open space is still not consistent throughout the sheets and tables. Please check sheets 1,
4, and all plan sheets.

Conservation Plan Checklist — To be placed on Landscape Plans
(Handbook, pp III - 284 - 111 -297 for complete specifications)
The following items shall be shown on the plan:
❑ Trees to be saved;
❑ Limits of clearing (outside dripline of trees to be saved);
❑ Location and type of protective fencing;
❑ Grade changes requiring tree wells or walls;
❑ Proposed trenching or tunneling beyond the limits of clearing.
2. Markings:
❑ All trees to be saved shall be marked with print or ribbon at a height clearly visible to equipment operators.
❑ No grading shall begin until the tree marking has been inspected and approved by a County Inspector.
3. Pre - Construction Conference:
❑ Tree preservation and protection measures shall be reviewed with the contractor on site.
4. Equipment Operation and Storage:
❑ Heavy equipment, vehicular traffic and storage of construction materials including soil shall not be
permitted within the driplines of trees to be saved.
5. Soil Erosion and Stormwater Detention Devices:
❑ Such devices shall not adversely affect trees to be saved.
6. Fires:
❑ Fires are not permitted within 100 feet of the dripline of trees to be saved.
7. Toxic Materials:
❑ Toxic materials shall not be stored within 100 feet of the dripline of trees to be saved.
8. Protective Fencing:
❑ Trees to be retained within 40 feet of a proposed building or grading activity shall be protected by fencing.
❑ Fencing shall be in place and shall be inspected and approved by a County Inspector prior to grading or
construction.
9. Tree Wells:
❑ When the ground level must be raised within the dripline of a tree to be saved, a tree well shall be provided
and a construction detail submitted for approval.
10. Tree Walls:
❑ When the ground level must be lowered within the dripline a tree to be saved, a tree wall shall be provided;
and a construction detail submitted for approval.
11. Trenching and Tunneling:
❑ When trenching is required within the limits of clearing, it shall be done as far away from the trunks of trees
as possible. Tunneling under a large tree shall be considered as an alternative when it is anticipated that
necessary trenching will destroy feeder roots.
12. Cleanup:
❑ Protective fencing shall be the last items removed during the final cleanup.
13. Damaged Trees:
❑ Damaged trees shall be treated immediately by pruning, fertilization or other methods recommended by a
tree specialist.
NOTE: IT IS THE DEVELOPER'S RESPONSIBILITY TO CONFER WITH THE CONTRACTOR ON TREE
CONSERVATION REQUIREMENTS.
