Submittal Date: Planner: Dear Mr. Mallory: Shiflett Farm LLC 2421 Ivy Road Charlottesville, VA 22903 30 June 2008 Patrick Lawrence, Planner The Planner for the Zoning and Current Development Division of the Albemarle County Department of Community Development will recommend approval of the plat referred to above when the following items have been satisfactorily addressed. (The following comments are those that have been identified at this time. Additional comments or conditions may be added or eliminated bases upon further review.) [Each comment is preceded by the applicable reference to the Albemarle County Code.] 1. [14- 302(A) 9] Building sites on proposed lots. Please show the location, area and dimensions of a building site on each proposed lot complying with the requirements of section 4.2 of the zoning ordinance. Or, show the following note: "Each lot contains a building site that complies with section 4.2.1 of the Albemarle County Zoning Ordinance. " 2. [14 -303 J] Restrictions. Please include any restrictions imposed in conjunction with the approval of the preliminary plat and their period of existence. If the length of a restriction makes its inclusion on the final plat impractical, and does not necessitate the preparation of a separate instrument, reference shall be made to the restriction on the final plat. 3. [14 -317] Instrument evidencing maintenance of certain improvements. If the subdivision will contain one (1) or more improvements that are not to be maintained by the county or any authority or other public agency, the subdivider shall submit 1 with the final plat an instrument assuring the perpetual maintenance of the improvement. 4. [14 -4181 Fire protection. Where public water is reasonably available, a final plat shall not be approved without verification from the service authority and the department of fire and rescue that adequate capability exists to provide adequate fire protection to serve the subdivision, including required fire flows, together with all other developments to be served by the system. Fire hydrants and distribution systems shall be installed and constructed by the subdivider. Hydrant locations and fire flow requirements shall be as prescribed by Insurance Service Offices (ISO) standards and be subject to approval by the department of fire and rescue, or the service authority, whichever requirements are greater. In areas where public water is not reasonably available, the department of fire and rescue may require such alternative provisions as deemed reasonably necessary to provide adequate fire protection. The Plat: Sheet One of Four — Notes: 5. Note #7 Please note and show that there are environmentally sensitive areas within the site, i.e. wetlands for future reference. 6 Delete Note # 11 7. Note #12 Please apply the setbacks according to the previously approved variation request, including the setbacks between buildings. State the conditions of the variation to the approved application plan. 8. Note # 17 Please state "Open Space `A' and Opens Space `B' care are dedicated to Albemarle County upon the approval of the Department of Parks and Recreation. Open Space `B' is to be maintained by the Homeowners Association. 9. Note # 18 Please change "heron" to "hereon." 10. Note # 19 refers to a site plan, with 5' sidewalks and 6' planting strips "per site plan." The site plan has not been submitted for this review to this office. The Department of Parks and Recreation and Engineering has received a landscape plan. However, a "site plan" has not been received in this section for review. Sheet Two of Four: 11. Please change the note referring to the abandonment of the 10' pedestrian easement to reflect that the vacation of the easement will be in conjunction with the construction of Eastern Avenue. Sheet Three of Four: 12. Lots 109 and 110 are shown in the Stream Buffer and no disturbance is allowed. Please note that no disturbance is allowed. Sheet Three "B" of Four: 13. Please note on the plat and by maintenance agreement that "Rella Court" as a private ingress and egress street will be maintained by the homeowners association. Final approval of this plat will be subject to approval of Albemarle County Departments of Future Development, Parks and Recreation, Engineering, Virginia Department of Transportation, Albemarle County Service Authority, and Fire and Rescue. Final approval of the final plat will be granted with the posting of all requisite bonds. Further comments may be forthcoming from the departments listed above and other county agencies not listed.
