HomeMy WebLinkAboutSP200800001 Review Comments Special Use Permit 2008-09-16County of Albemarle Department of Community Development Memorandum To: Scott Clark, Senior Planner From: John Shepherd, Manager of Zoning Administration Date: September 16, 2008 Subject: SP -2008-1 East Pantops Athletic Facility I have reviewed this request for a special permit to allow an athletic facility on this property and offer these comments on the plan revised on August 18, 2008. These comments may be revised after further review and discussion with other staff. This is a new comment. The height of the building is limited to 35 feet per section 10.4. The determination of the height is based on the definition provided below. The front of the building is the elevation that faces the parking lot. Building, Height of: The vertical distance measured from the level of the curb or the established curb grade opposite the middle of the front of the structure to the highest point of the roof if a flat roof; to the deck line of a mansard roof; or the mean height level between the eaves and ridge of a gable, hip or gambrel roof. For buildings set back from the street line, the height shall be measured from the average elevation of the ground surface along the front of the building. 2. This division defers to the opinion of the Planning Division regarding the appropriateness of this use in this location. 3. This can be approved as a swim, golf, tennis or similar athletic facility in the RA district as provided in section 10.2.2 (4) and subject to the supplemental regulations of 5.1.16. These sections must be referenced on the plan. The supplementary regulations are attached. 4. Be aware that this use has typically but not exclusively been for outdoor facilities such as ball fields and golf courses. The proposed indoor facility with 50 employees has characteristics that are similar to indoor athletic facilities or commercial recreation facilities are only permitted in commercial and industrial districts. The ordinance does not paint a bright line between these uses. The plan requires a waiver for the disturbance of critical slopes. The request for this modification has been submitted. 5.1.16 SWIMMING, GOLF, TENNIS CLUBS Each swimming, golf or tennis club shall be subject to the following: a. The swimming pool, including the apron, filtering and pumping equipment, and any buildings, shall be at least seventy-five (75) feet from the nearest property line and at least one hundred twenty-five (125) feet from any existing dwelling on an adjoining property, except that, where the lot upon which it is located abuts land in a commercial or industrial district, the pool may be constructed no less than twenty-five (25) feet from the nearest property line of such land in a commercial or industrial district; b. When the lot on which any such pool is located abuts the rear or side line of, or is across the street from, any residential district, a substantial, sightly wall, fence, or shrubbery shall be erected or planted, so as to screen effectively said pool from view from the nearest property in such residential district; c. (Repealed 6-14-00) d. The board of supervisors may, for the protection of the health, safety, morals and general welfare of the community, require such additional conditions as it deems necessary, including but not limited to provisions for additional fencing and/or planting or other landscaping, additional setback from property lines, additional parking space, location and arrangement of lighting, and other reasonable requirements; e. Provision for concessions for the serving of food, refreshments or entertainment for club members and guests may be permitted under special use permit procedures.
