Subject: SDP2008 -00065 Moser Radiation Therapy Center - Major Amendment
The County of Albemarle Division of Zoning and Current Development will grant or recommend approval of
the major amendment referred to above once the following comments have been addressed: [Each comment is
preceded by the applicable reference, which is to the Subdivision/Zoning Ordinances unless otherwise
specified.]
1. [21.7.2] No portion of any structure, excluding signs, shall be located closer than fifty (50) feet to any
residential or rural areas district. No off - street parking or loading space shall be located closer than
twenty (20) feet to any residential or rural areas district. The 20 foot undisturbed buffer should stay as
is. (Make sure the 20 foot buffer is not disturbed anv further] this includes activities during construction.
There currently is parking within the 20' buffer. See comment #3 for more details.
2. [32.5.6]Provide on the site plan a description of all variances, zoning proffers, bonus factors or
special use permits applicable to this site. All conditions of the latest zoning map amendment VMA
1990000261 should be scanned onto the site plan.
3. Minimum setback lines, the minimum setbacks for the Commercial C1 zoning district shown in the site
data table are incomplete. Include the adjacent to residential districts requirement, and buffer zone
requirements for commercial uses adjacent to residential and rural area districts. Refer to the Albemarle
County Zoning Ordinance section 21.7 minimum yard requirements [Commercial Districts generally] for
the complete setbacks. [Correct the setbacks on the site plan].
4. [4.12.5(A)]Parking areas on same lot as primary use; exception. All parking spaces shall be established on
the same lot with the primary use, to which it is appurtenant, except as authorized by [section
4.12.8].therefore, [section 4.12.8.e] An instrument assuring the continuation of off -site shared parking needs
to be submitted. The instrument shall be in a form that is suitable for recording, shall be subject to review
and approval as to form and substance by the county attorney, and shall be recorded in the office of the clerk
of the circuit court of the county before the site plan or site plan waiver is approved. As the parking
requirements for the use or structure change, subsequent instruments may be submitted, reviewed, approved
and recorded that rescind or modify the prior instrument. Parking study will address this? The site data
notes indicate that 13 spaces necessitated by this expansion will be provided on the Sieg property. Based
on our Last conversation with Mr. Hurt, he indicated that the latest traffic study conducted established
that based on the use; there was enough /sufficient parking on this site. Please confirm and add a note to
the site plan. A copy of the parking study will have to be submitted with this plan for our files.
