Dear Mr. Collins:
Thank you for your recent submittal received on August 20th for the above noted project for Tax
Map and Parcels 33-1D (portion).
The following comments are provided to help you meet requirements for CO (Commercial Office) District
and address staff concerns:
Proffers:
• As you may be aware, your request for a parking modification has been approved with
conditions that tie the storage use directly to the office uses on the upper four floors of each
office building. The proffers include compliance with the application plan that includes the
parking and use breakdown of the proposed buildings, which is consistent with the modification
approval. The Proffer Statement needs to be revised to reflect the latest revision date for the plan
dated 8-18-08 as referenced in proffer #4.
• The applicant has also indicated a willingness to proffer that the basement of building one and
the two basements of building two will be used for general, file and/or data storage.
• Revised proffers need to be submitted.
Albemarle County Service Authority (ACSA):
9 At this time, ACSA cannot accept the projected wastewater flows until all improvements to the
Camelot Wastewater Treatment Plant are complete.
Other Issues:
• Since changes to the site are proposed due to the slight relocation of the residential building, a
revised site plan will be required.
• The plan submitted with this application uses a pond to be constructed on the adjacent federal
property for stormwater management. The army claims to be exempt from all County review.
Therefore, it is not known whether this site meets the County Water Protection Ordinance
requirements. While it is recommended that this be demonstrated prior to any additional
approvals on this property, in any case, this will be required prior to approval of site plans or site
plan amendments.
After you have reviewed these comments, if you wish to meet with staff on the comments, please let me
know and I will set up a meeting.
When you are ready to resubmit, please provide that re -submittal on a re -submittal Monday (see attached
schedule). Make sure to put my name on the cover page of your re -submittal. After you have
resubmitted, staff will provide a set of written comments for your review prior to setting a public
hearing. In those comments, we will advise you as to whether all substantive issues have been resolved
or if additional resolution is needed.
A public hearing with the Planning Commission will not be advertised until you advise us that the
project is ready to proceed to a public hearing. At that time, the legal advertisement will be run in the
newspaper and a staff report will be prepared to go to the Planning Commission.
Please be advised that, once a public hearing has been advertised, only one deferral prior to the Planning
Commission's public hearing will be allowed during the life of the application. The only exception to
this rule will be extraordinary circumstances, such as a major change in the project proposal by the
applicant or more issues identified by staff that has not previously been brought to the applicant's
attention. As always, an applicant may request deferral at the Planning Commission meeting.

Re: NGIC — Request for Parking Modification (TM 33, portion of Parcel 1D)
Dear Mr. Collins,
This letter serves to provide a written record of the parking modification approval for the
above -noted property in accordance with Section 4.12.2 c.1 of the Albemarle County
Code (Zoning Ordinance). This is in response to your request for modification, dated
August 18, 2008 and revised September 24, 2008.
The previously approved rezoning and special use permits for this site called for two
office buildings of 89,400 gross square feet of floor area each. This is a total of
178,800 gross sf. Based on the ordinance standard for 80% net and 1 space per 200
square feet of office use, 716 parking spaces were required (calculated per floor for
both buildings). Additionally, a third building will house 120 residential units, requiring
240 parking spaces. A total of 783 parking spaces were proposed with the original
plan, with 173 spaces shared by the offices and residential units.
The office buildings are now being proposed with one having a basement storage level
of 22,100 gross sf. and the other having two basement floor levels totaling 44,200 gross
sf. (a total of 66,300 gross sf.). These building additions, if approved by the Board of
Supervisors with the ZMA-2008-004, SP -2008-045 & SP -2008-046 will be permitted
without the requirement of additional parking spaces, based on our understanding of
the limitations outlined in your request, with several conditions of use for the buildings.
These conditions of use are the basis for and part of this parking determination. Any
zoning clearances for current or future users will be limited by these conditions, until
and unless a future parking determination is made to amend this one. They are as
follows:
1. The net office area for the building (for the purpose of determining parking
requirements) is a maximum of 178,800 gross sf.
2. The gross square footage in the three basement floors shall be limited to storage
use only for the occupants of the office floors and may not be occupied as active
offices.
Any conversion of this space to active office area (with offices, meeting__
rooms or the like) or any other use will be a violation of this approval. Each
designated storage area in this basement shall be limited in terms of electrical
and telephone service. It is recommended (not required) that the ceiling height
__in each storage area -be reduced. to a maximum head room of 6. feet 6 inches....___
This is a common zoning practice for cases in which parking is reduced based
on substantial area devoted to storage.
3. Any future tenants will be subject to compliance with our parking regulations.
The current parking analysis assumes a general office use and the three
basement floors used exclusively as storage for the office users. Future tenants
may be limited by available parking. (Please check with us prior to finalizing
leases with future tenants.)
If you have any questions, please do not hesitate to ask. If there -are corrections or
revisions to these assumptions or conditions, please inform me.
If you are aggrieved by this determination, you have a right to appeal it within thirty (30)
days of the date notice of this determination is given, in accordance with Section 15.2-
2311(A) of the Code of Virginia. If you do not file a timely appeal, this determination
shall be final and unappealable. An appeal shall be taken only by filing with the Zoning
Administrator and the Board of Zoning Appeals a notice of appeal which specifies the
grounds for the appeal. An appeal application must be completed and filed along with
the fee of $120. The date notice of this determination is being given is the same as the
date of this
