The applicant has requested reduced yard setbacks. This may only be done with a variance. 2. Disturbance of critical slopes is proposed. The applicant should submit the necessary information to allow review of the request. The waiver should be processed with the special use permit. By separate cover I will send you a template for the critical slopes waiver report. 3. Waiver of undisturbed buffer adjacent to Railroad. Please verify with the Zoning Administrator that the buffer is required. If so, the modification should be processed with the special use permit. 4. A utility(?) easement is shown across the front of the property. This will affect the placement of street trees. Further, the applicant proposes to delay planting of trees until phase II. This requires a modification to the ordinance (32.7.9.2). This modification may be approved by the agent as provided by Section 32.7.9.3. However, past practice has been for the agent to not grant this modification when a rezoning or special use permit is under consideration. Rather, the modification has been considered by the Planning Commission and Board of Supervisors as a factor for consideration of the appropriateness of the special use permit as a whole. 5. Limited area is available for stormwater management. 6. The phasing plan proposed by the applicant should be considered conceptual at this time. Phasing can be accomplished during site plan review. Each phase proposed must be able to stand on its own or with features built with prior phases.
