Mrs. Cottrill,
I received your request to pay into the Albemarle County Stream Buffer
Mitigation Fund for the stream buffer disturbance proposed to construct the
Logan's Run Subdivision on TMP 95 -5.
Where disturbance of a stream buffer is allowed, required mitigation is based
upon the area disturbed. The mitigation ratio is 2:1 measured in square feet or
acres. The proposed buffer disturbance has been calculated at 0.15 ac,
therefore, mitigation requirements are based on 0.30 ac.
Payment into Albemarle County Stream Buffer Mitigation Fund is $6875 per acre
plus the cost of incorporation into the Thomas Jefferson Soil & Water
Conservation District ($11,000 plus $1000 per lot). The total cost is estimated
to be $2062 + $13,000 = $15,062.
The option to pay into the Fund is only authorized by the County when other
mitigation methods are not available. County staff needs to evaluate the
existing buffer to determine if there is an opportunity for new plantings.
If the current buffer provides the opportunity for new plantings, mitigation is
required at 2 times the disturbed acreage (0.15 x 2 = 0.30ac) and the following
options are available (from the Albemarle County Design Standards Manual):
a. For every 400 square foot unit or fraction thereof, plant one (1) canopy tree
measuring 1 1,�" - 2" caliper or a large evergreen 6 feet in height, one (1)
understory tree measuring 3/4" - 1 I/V" caliper or one evergreen 4 feet in height,
and one (1) small shrub 15" - 18" in height.
0.30ac x 43,560sf /ac = 13,068sf
13,068sf x (1 canopy tree + 1 understory tree + 1 shrub) /400sf = 33 of each
plant (canopy tree, understory tree, shrub) would be required for a total of 99
plants.
b. For every acre or fraction thereof, plant 1,210 hardwood and /or pine
seedlings on approximately 6'X6' centers without tree tubes and mats.
0.30ac x 1210 = 363 seedlings without tubes & mats
c. For every acre or fraction thereof, plant 600 hardwood and /or pine seedlings
on approximately 8'X8' centers with tree tubes and mats.
0.30ac x 600 = 180 seedlings with tubes & mats
In the next two weeks a County Staff member will visit your property to evaluate
the current stream buffer and make a finding on the requirements of mitigation.
