Marotta, Senior Planner Re: SUB200800229 Loose 2 -Lot Subdivision The Zoning and Current Development Division of the Albemarle County Department of Community Development will approve the proposed plat referred to above when the following items have been satisfactorily addressed. (The following comments are those that have been identified at this time. Additional comments or conditions may be added or eliminated bases upon further review.) Each comment is preceded by the applicable reference to the Albemarle County Code. 1. [Sec. 14- 302A1] Name of subdivision. COMMENT: Please update title to reflect that this is a subdivision and not a boundary line adjustment. 2. [Sec. 14- 302A2] Vicinity Map. COMMENT: This section requires the vicinity map be provided at a scale of 1'= 2000'. Please revise the map. 3. [Sec. 14- 302A3] Existing or platted streets. COMMENT: Please provide right -of -way width for State Route 22. 4. [Sec. 14-302A10] Right of further division of proposed lots. COMMENT: Per this section, provide required note verbatim, to include the part of the statement that says "... and when further divided these rights shall not compromise more than [number] acres...." 5. [Sec. 14- 302B7] Reservoir watershed. COMMENT: Please refer to drinking water supply watershed as "reservoir watershed." 6. [Sec. 14- 3021391, [Sec. 14 -3081 Flood plain. COMMENT: Please confirm this property does not contain flood plains as defined in Sec.30.3 of the Zoning Ordinance. County GIS indicates the presence of 100 -year floodplain on the property. If necessary, please revise Note #2 on the plat to reflect what is present on the site. 7. [Sec. 14 -302B] Stream buffers note. COMMENT: Please confirm whether this property contains a required stream buffer, as Albemarle County GIS indicates the presence of a stream buffer per the Albemarle County Water Protection Ordinance. If a stream buffer is required, please show it on the plat and provide the required note. 8. [Sec. 14 -306], [Sec. 14 -316] Private streets information, Approval of entrance on public streets. COMMENT: VDOT approval of new private street entrance is required prior to approval of the final plat. Also, in accordance with this section, please rename the "50' access easement" to "50' private street easement." 9. [Sec. 14 -303Q] Water supply. COMMENT: This note must be provided verbatim. 10. [Sec. 14 -303R] Parent parcel access. COMMENT: Please provide required note. 11. [Sec. 14 -303S] Control points. COMMENT: Provide control points as required. 12. [Sec. 14- 308.1] Groundwater assessment information. COMMENT: In accordance with this section, this application requires a groundwater assessment. In order for this application to be deemed complete, you must submit the $275 fee by December 18, 2008. If you have any questions about this, please call Josh Rubinstein at 434 - 296 -5832 x3432. 13. [Sec. 14- 309,310,416] Soil evaluations, Health Director approval, Individual private wells and septic systems. COMMENT: Health Department approval must be granted prior to approval of the final plat. In accordance with these sections of the County Code, please submit 3 sets of soils work to me for processing. 14. [Sec. 14 -317] Instrument evidencing maintenance of certain improvements. COMMENT: A private street maintenance agreement is required to be approved by the County Attorney prior to approval of the final plat. Please submit a draft to me for review. 15. [Sec. 14 -404] Lot location to allow access from lot onto street or shared driveway. COMMENT: This section requires all lots in the subdivision to be served by a street established at the same time as the subdivision. While it is not shown on the plat, the existing (parent) parcel is served by an existing driveway onto State Route 22. In order for the final plat to be approved, both lots must be served only by a street created with this subdivision, or a waiver must be obtained. A waiver of this section, in accordance with section 14- 225.1, may be requested. 16. [Sec. 14 -434] Completion of on -site improvements required prior to plat approval. COMMENT: Per the comment above, if a waiver is not granted and the new private street does not utilize the existing point of ingress /egress, the existing driveway would have to be closed prior to final plat approval.
