RE: SUB2008 -238- Clark/ Schuyler- Boundary Line Adjustment
Mr. Key:
The above Boundary Line Adjustment has been administratively denied because revised `Parcel B' will
not have a development right and two acres from the parcel as it existed in 12/10/80, most commonly
known as the `kernel rule'. Therefore, this plat does not comply with Chapter 14 Section 400 of the
Albemarle County Code. The history and reasoning is explained below.
1. A boundary line adjustment was submitted and approved in February 2008 that gave TMP
126 -43 two acres, and a development right from TMP 126 -44. See attachment W.
2. A subsequent two - lot subdivision for TMP 126 -43 was submitted and approved in August
2008 where the development right that was given with the original boundary line adjustment
was utilized. See attachment '13'.
Therefore, with the current proposed boundary line adjustment, the development right that allowed the
previous two -lot division is being added back to the kernel parcel, TMP 126 -44.
