Subject: S.P. 2008 -052 Forest Lakes Office Park
This application if approved, will abate a pending zoning violation. (See the enforcement history at the
end of this document.) This violation is a) a use violation because they are utilizing off -site and
standalone parking (without approval of an S.P.) and b) a site plan violation because the dumpster has
been relocated. We have no objection to this request and look forward to the abatement of this
violation.
Zoning suggests that the site plan amendments also be reviewed and processed concurrently with the
S.P. application. Please seek appropriate staff review of the location of a) the new dumpster location,
once the applicant clarifies the proposed location on the plan; and b) the relocation of handicapped
parking.
Please be advised and remind the applicant that this property and the office uses are subject to the
conditions of S.P. 94 -16 allowing offices in a R -15 zoning district. There is an expectation that staff
confirm compliance with applicable historic conditions for new applications. I suggest that you ask the
applicant to specifically address his compliance with each condition. Those conditions are as follows:
1. Compliance with the provisions of Section 21.0; The plan should be revised to reflect these
setbacks and buffers. The current stated setbacks are not consistent with this condition.
2. Provision of landscaping adjacent to Timberwood Boulevard consistent with that provided on
Timberwood Boulevard in the commercial area; This appears to be complete and staff will
confirm.
3. Provision of vegetative screening designed to minimize visibility of the site from the Arbor Lake
townhomes; This is required now only for the currently developed area. Staff will need to
confirm this has been done or it will need to be done.
4. Provision of a walkway to connect the existing walkways adjacent to the lake to the shopping
area. This is required now only for the currently developed area. Staff will need to confirm this
has been done or it will need to be done.
A brief history of the zoning enforcement on this site:
• Site plan violation relating to several separate things (landscaping, dumpster, etc.) originally
dates back to 2004.
• A site plan amendment to address the violation was approved early 2006.
• The site was not corrected per the amended plan and a new Notice of Violation was sent out
February 29, 2008.
• Several sets of civil penalties have been filed against the owners.
• August, 2008 staff met with the applicant to discuss their options for compliance, including
filing the S.P. application.
