Jefferson Street Charlottesville, VA 22902 RE: SUB - 200800254- Redfields Phase V -Final Dear Mr. Collins: This letter is to notify you that the above referenced subdivision application has been denied as it does not comply with the following applicable sections of the Albemarle County Code. (Staff comments have been provided.) 1. [Sec. 14 -224A] Review and action on final plat by agent. Upon receipt of a final plat from the site review committee, the agent shall review the final plat as follows: A. The agent shall review the final plat for compliance with the requirements of this chapter in effect at the time of preliminary plat approval, provided that all other requirements of sections 14 -300, 14 -301 and 14 -303 are met. For the final plat of each section of a phased subdivision, the agent shall also review the final plat for compliance with applicable regulations, and all requirements of the zoning ordinance in effect at the time the plat for that section is being reviewed or, in the case of a planned development, the zoning ordinance selected by the subdivider under section 8.5.5.2 of the zoning ordinance. The agent shall make a good faith effort to identify all deficiencies, if any, during the review of the first plat submittal. The agent shall consider the recommendations and determinations made by the site review committee. COMMENT: This proposed subdivision does not meet the standards of the existing zoning approval. Per the Zoning Administrator in the determination letter dated October 25, 2005, this subdivision cannot be approved until the Redfields property is rezoned. A copy of that letter is attached for your reference. 2. [Sec. 14 -403] Lot frontage. COMMENT: In order for the subdivision of property that does not include Redfields to be processed as a rural subdivision, all lots in the subdivision must meet the minimum requirements for frontage. As proposed, they do not. Please revise the lots to meet the requirements for frontage for a rural subdivision, or this plat must be processed as a standard subdivision. 3. [Sec. 14- 302A2] Vicinity map. COMMENT: Per the requirements of this section, please provide vicinity map at a scale of 1 "= 2000'. 4. [Sec. 14- 302A31 Existing or platted streets. COMMENT: Please provide state route information if applicable, and indicated whether the existing streets shown are public or private. 5. [Sec. 14- 302A4 -5] Public and Private easements. [Sec. 14 -303L] Public utility, drainage, and sight distance easements. COMMENT: Please revise the graphics to more clearly delineate the extents of the easements shown on the plat. Specifically, it is difficult to determine the extents of the new sign and landscape, variable width VDOT drainage, and stormwater management, and 120' VEPCo easements shown in the southeast corner of the property. COMMENT: Does the 20' waterline easement belong to ACSA? Please add easement owner information to the call -out. 6. [Sec. 14- 302A9] Building sites on proposed lots. COMMENT: Please provide evidence that each lot contains a building site per this section of the ordinance. 7. [Sec. 14- 302A10] Right of further division of proposed lots. COMMENT: Provide required notes and development rights information, as required by this section. 8. [Sec. 14 -301B] Form and style of plats. COMMENT: 1" =250' is not an acceptable scale. Please revise and provide plat at a scale that is a multiple of 100 (i.e. 1:200, 1:300). 9. [Sec. 14- 302B61 Tax map and parcel number. COMMENT: Please change parcel reference from "Parcel ID" to "tax map and parcel number ". 10. [Sec. 14- 302B7] Reservoir watershed; agricultural forestral district. COMMENT: Provide agricultural forestral information, as required by this section. 11. [Sec. 12- 302B8] Yards. COMMENT: Provide required yard information for RA district on the plat. (None for PRD). 12. [Sec. 14 -303I] Bearing and distance ties. COMMENT: Please mark ALL corners clearly. It is not possible to determine the start and end of line and curve segments as it is drawn. 13. [Sec. 14 -306] Private streets information. [Sec. 14 -316] Approval of entrance on public streets. [Sec. 14 -404] Lot location to allow access from lot into street or shared driveway. COMMENT: VDOT approval is required for new ingress /egress onto a public street. Intended ingress /egress is not shown on this plat, however, please be aware that if this plat is processed as a commercial subdivision, section 14 -404 will apply. 14. [Sec. 14 -303R] Parent parcel access. COMMENT: Provide note required by this section. 15. [Sec. 14 -303N] Statement pertaining to private streets. COMMENT: Again, if this plat is processed as a standard subdivision, this section requires a standard note is provided when a private street is proposed. 16. [Sec. 14 -317] Instrument evidencing maintenance of certain improvements. COMMENT: A private street maintenance agreement is required if a private street is proposed. If applicable, please submit a maintenance agreement to this office for review. The final plat cannot be approved until the County Attorney approves the maintenance agreement. 17. [Sec. 14 -303S] Control points. COMMENT: Provide control points as required by the ordinance. 2 18. [Sec. 14 -309] Soil evaluations. [Sec. 14 -310] Health director approval of individual private well and/or septic. [Sec. 14 -416] Individual private wells and septic systems. COMMENT: Final plat approval cannot be granted without health department approval. Three copies of the soils work are required for review. 19. In addition, please note that it is not sufficient to provide " Redfields Phase 2 -B" as the adjacent property owner if the lots have been recorded and sold. Please provide the adjacent owner information for each adjacent property owner. Please note that Sec. 14 -226 is attached for your reference. If a preliminary or final plat is disapproved by the agent or the commission: A. Judicial review. It may be subject to judicial review as provided in Virginia Code §§ 15.2- 2259(C) and 15.2- 2260(E). B. Appeal to board of supervisors. In the alternative and in addition to seeking judicial review, and at the sole option of the subdivider, the subdivider may appeal the disapproval to the board of supervisors. The appeal shall be in writing and be filed with the agent within ten (10) days of the date of the disapproval. The board may affirm, reverse, or modify in whole or in part, the disapproval. In so doing, the board shall give due consideration to the recommendations of the agent, the site review committee or the commission. In addition, it may consider such other evidence as it deems necessary for a proper review of the application. C. Reuubmittal. In the alternative and in addition to seeking judicial review, and at the sole option of the subdivider, the subdivider may resubmit the plat after it has been modified or corrected to address the deficiencies identified by the agent or the commission. The modified or corrected plat shall be resubmitted to the agent within thirty (30) days' of the date of the disapproval. The agent or the commission, as the case may be, shall act on the resubmitted plat within forty -five (45) days after the date it was resubmitted. If the resubmitted plat is disapproved, the subdivider may seek judicial review, appeal the disapproval to the board of supervisors, or resubmit a modified or corrected plat as provided herein.
