The engineering analysis of the request follows: Description of critical slope area and proposed disturbance: The critical slope areas, within TMP 60 -57, 57a, 57b, and 57c, appear to be a mix of manmade and natural slopes. The disturbance of critical slopes is requested by the applicant to reconstruct the roadway and construct a new School, perform grading operations, and install a stormwater management facility. Areas Acres Total site in St Anne's Belfield 28.05 Critical slopes Approx. 3.55 Approx. 12.66% of the site Critical slopes disturbed 1.39 Approx. 4.96% of critical slopes Below, each of the concerns of Zoning Ordinance section 18 -4.2 is addressed: 1. "movement of soil and rock ": Proper slope construction, control of drainage, and vegetative stabilization with approved erosion control measures constructed within the standards of Virginia Erosion and Sedimentation Control Regulations should prevent any movement of soil. 2. "excessive stormwater run - off": Stormwater runoff will be controlled by the drainage / stormwater management plan required for this site. 3. "siltation of natural and man -made bodies of water ": There is an existing Stormwater basin located at the lowest reaches of the site that is designed to contain any sediment loss that may occur due to excessive rainfall. All site related sediment and erosion controls will protect the existing basin from sedimentation. Inspection and bonding by the County will ensure siltation control during construction. Proper stabilization and maintenance will ensure long term stability. 4. "septic effluent ": No septic systems or drainfields are proposed in this project. This site is accessible to the public sanitary sewer system. This site does not drain into a waterway that is a public drinking water supply for Albemarle County. No portion of this site plan is located inside the 100 -year flood plain area according to FEMA Maps, dated 04 February 2005. Exemptions [18- 4.2.6a,c]: The critical slope disturbance appears to be on previously manmade slopes created during the construction of the original school building and subsequent additions to the site over the years. Plans could not be located for the original construction of the school for verification of some of the manmade critical slopes. However, from the University of Virginia, aerial photography from 1937 and 1957 shows the original school building location and grading is assumed in this area. The plans on record for the school show the constructed slopes in the area of the new building 18- 4.2.6a. Any structure which was lawfully in existence prior to the effective date of this chapter and which is nonconforming solely on the basis of the requirements of section 4.2, may be expanded, enlarged, extended, modified and/or reconstructed as though such structure were a conforming structure. For the purposes of this section, the term "lawfully in existence" shall also apply to any structure for which a site development plan was approved or a building permit was issued prior to the effective date of this chapter, provided such plan or permit has not expired. (Amended 10- 17 -01) 18- 4.2.6c- Accessways, public utility lines and appurtenances, stormwater management facilities, and any other public facilities necessary to allow the use of the parcel shall not be required to be located within a building site and shall not be subject to the requirements of this section 4.2.2, provided that the applicant demonstrates that no reasonable alternative location or alignment exists. The county engineer shall require that protective and restorative measures be installed and maintained as deemed necessary to insure that the development will be consistent with the intent of section 4.2 of this chapter. (Added 10- 17 -01) Recommendation: Based on the above review, engineering recommends approval to the critical slope waiver.
