Subject: Little Yellow Mountain Final Plat (SUB200800240)
The Engineer for the Zoning & Current Development Division of the Albemarle County Department of
Community Development will recommend approval of the plat referred to above when the following items
have been satisfactorily addressed. (The following comments are those that have been identified at this
time. Additional comments or conditions may be added or eliminated based on further review.) [Each
comment is preceded by the applicable reference to the Albemarle County Code.]
1. [14 -302 (B)(10)] Stream Buffers. Please add and label the existing 100' stream buffers on Powell's
Creek and the tributary which crosses TMP 55 -40. The location of these buffers can be found on the
Albemarle County GIS website.
REV 1: Comment has been addressed.
2. [ 14 -304] Request for critical slopes waiver. A waiver to disturb critical slopes must be granted by the
Planning Commission. Please submit a waiver request per 18- 4.2.5, including an analysis of the
disturbance. This analysis must include the area of all critical slopes which will be disturbed for the
purposes of road upgrades, proposed driveways, and proposed construction of home and drainfield
sites.
REV 1: A Critical Slopes Waiver will be required if the Private Street Request is not approved and a
public street must be built to serve the subdivision.
[ 14 -306] Private streets information. Provide the information required to support authorization for the
proposed private street under the applicable requirements of sections 14- 232,14 -233, and 14- 234(A).
REV 1: Information is to be provided for an earthwork analysis comparing a private street to a
public street.
4. [14 -303 (E)] Dimension standards and information on all lots, streets, alleys, easements, and shared
driveways. As a private street in the Rural Area, Ruhr Pocket Lane must meet the minimum standards
of 14 -412 (A) (2) Streets serving three tofive lots. This standard may be reduced to the criteria of 14-
412 (A) (1) Streets serving two lots where a driveway departs from the street and two lots remain to be
served, and a turnaround per 14 -412 (A) (2) is provided. Please submit vertical and horizontal
information demonstrating that the street meets this criteria. Upon further division of the proposed
parcels, some or all portions of Ruhr Pocket Lane may be required to meet the standards of 14 -412 (A)
(3) Streets serving six lots or more.
REV 1: This information is being provided with the Private Street Request.
5. [14 -303 (K)] Temporary turnarounds. Based on the potential of future division, please add the
following note to the plat: "The area on this plat designated as a temporary turnaround will be
constructed and used as other streets in the subdivision until Ruhr Pocket Lane is extended, at which

time the land in the temporary turnaround area will be abandoned for street purposes and will revert to
adjoining property owners in accordance with specific provisions in their respective deeds."
REV]: Comment has been addressed per a private street design.
6. [14 -303 (L)] Public utility, drainage and sight distance easements. Please calculate and label sight
distance easements at the entrance onto Mint Springs Road.
REV 1: Comment has not been addressed, please label site distance easements on the plat.
[ 14 -410 (F)] Principal means of access to subdivision. Please provide engineering calculations and
details necessary to determine that the discharge water of Powell Creek during a 25 -year storm will not
inundate, block, destroy, or otherwise obstruct Ruhr Pocket Lane. Further, the crossing of Powell
Creek must satisfy the County Water Protection Ordinance, specifically, Section 17 -320 (D), stream
buffer mitigation may be required.
REV 1: Comment has not been addressed, please submit calculations demonstrating that the 25 -year
storm will pass under the existing bridge without flooding Ruhr Pocket Lane.
[14 -343] Completion of on -site improvements required prior to plat approval. Ruhr Pocket Lane must
be constructed to the criteria of 14 -410 and 14 -412 prior to final plat approval, or surety may be posted
in lieu of completion of the improvements under section 14 -435.
REV 1: Comment is noted, bonding will be done at the time of the Final Plat..
9. [18- 4.6.6] LotAccess Requirements. Although not required to be shown on this plat, all driveways to
proposed building sites must meet the criteria of this section. It must be demonstrated that this criteria
is met prior to the issuing of building permits for the proposed lots.
REV 1: Comment is noted, driveway criteria is not part of this review.
10. This plat is subject to County Code Chapter 17 Water Protection Ordinance. Please submit a Water
Protection Ordinance Application including Erosion and Sediment Control Plans per Article II and
Stormwater Management and Water Quality Plans per Article III.
REV 1: Comment will be addressed with Final Plat.
11. Work within Powell Creek may require permits from federal or state agencies. Please submit copies of
these permits.
