Please find comments from reviewing departments and agencies included in this letter. or attached. Albemarle County Community Development Department o Planning — Rural Areas o Planning — Architectural Review o Zoning (attached) Comments — SP 2007-28 (Church) Planning — Rural Areas (Scott Clark) ➢ We would recommend that you not begin revisions based on these comments until after the Architectural Review Board hearing on January 20`'' ➢ The Planning Comission's guidance on this project was that, while they are willing to consider a church on this site, the site would need to be redesigned to minimize grading, breaking up large areas of parking, and reducing the overall number of parking spaces. These concerns have been addressed to some extent, but this is still a very large facility for the Rural Areas, and is inconsistent with the Comprehensive Plan goals for the Rural Areas. ➢ For a project of this size, the traffic analysis requested by VDOT should be submitted as part of the SP application, prior to public hearing, as traffic impacts are part of the overall concern with the scale of this project. ➢ It would be helpful to have cross-sections of the site to show the extent of cut and fill, in order to address the Planning Commission's design concerns. Architectural Review Board (Brent Nelson) • An ARB application for a Conceptual Review of the Site/ Building Design and an Advisory Review For a Special Use Permit has been received (ARB 08-171) and is scheduled for the 1/20/09 ARB meeting. The action taken by the ARB at the 1/20/09 meeting will be posted following the meeting. Sincerely, Scott Clark Senior Planner 0 � jRclti�� County of Albemarle Department of Community Development Memorandum To: Scott Clark, Senior Planner From: Amelia McCulley, Zoning Administrator Division: Zoning Date: January 5, 2009 Subject: S.P. 2007-028 and S.P. 2007-029 Faith Christian Center — church and daycare — second zoning comments (based on resubmittal 12-15-08) have reviewed the resubmittal and have the following initial comment: based on Section 31.2.4.2.2 of the Zoning Ordinance, since this item was deferred in October, 2007, it is considered withdrawn. I don't see where a request for extension was submitted. They should submit a new application and fee for our review. 31.2.4.2.2 WITHDRAWAL OF APPLICATION An application shall be withdrawn, or be deemed to be withdrawn, as provided herein: b. If the applicant requests that further processing or formal action on the application be indefinitely deferred, the application shall be deemed to have been voluntarily withdrawn by the applicant if the commission or the board does not take action on the application within twelve (12) months after the date the deferral was requested. Upon written request received by the director of planning and community development before the application is deemed to be withdrawn, the director may grant one extension of the deferral period for a period determined to be reasonable, taking into consideration the size or nature of the proposed use, the complexity of the review, and the laws in effect at the time the request for extension is made. (Added 10-3-01) The proposed parking meets our Ordinance. Additional comments are as follows: 1. If private sight distance easements are necessary for the installation of the entrance and turn lane, tentative approval from that property owner should be provided. 2. It appears that the 20 foot buffer will be disturbed in some areas. If that is the case, I suggest that the applicant submit a waiver request with a proposed replanting plan. This waiver can be administratively approved. 3. 1 suggest that tentative Health Department approval of the well and septic be obtained with the special use permit. It is important to find that this use can be accommodated within this property. 4. The parking regulations within the Ordinance require that a pick-up and drop-off area be provided for a day care center. Please address this requirement. 3
