Dear Ms. Miller,
As you know, the site plan and mylars for the Hollymead Town Center /Kohl's project were
approved on December 31, 2008. This letter is a follow -up to that approval and may be
considered your Certificate of Appropriateness.
The Certificate of Appropriateness is based on the following drawings: Site plan sheets C1 -C8,
C13 -14, C16 -19, Kohl's architectural elevation sheets A3 dated 12/19/08 and DE -1 revised 12-
30-08; Kohl's landscape sheet L1 revised 12- 30 -08; shopping center architectural drawings
A502 -505 dated October 3, 2008; and signage criteria sheet dated 12- 15 -08.
This Certificate is also based on the ARB's action of February 2, 2009, as follows:
HTC /Kohl's: Stormwater facility /landscaping
Motion: Regarding the landscaping of the HTC /Kohl's stormwater facility, the ARB took
the following action:
Mr. Missel moved for approval of the Certificate of Appropriateness for ARB -
2008 -165: Hollymead Town Center Area Al /Kohl's, including the stormwater
facility and its associated landscaping as illustrated on the plan displayed at the
meeting, Sheet C15 with revision date of 12/17/08.
Second: Mr. Wright
Vote: The motion carried by a vote of 3:0.
Related to this approval, please note the following:
1. This application is approved with the condition that mechanical equipment shall not be
visible from the Entrance Corridor.
2. This approval does not include any window signs. If window signs are proposed, a
separate application must be made, reviewed and approved by the Architectural Review
Board.

A. Site Plan (SDP200800113)
1. VDOT approval is required.
2. Guardrail or a parapet is required on the wall surrounding the drive - through lanes.
3. Drainage easements, stormwater easements, access to stormwater facilities, and road access easements
must be shown on the plat combining parcels, to be approved with the site plan.
4. Provide an end - section on structure outlet 1.
5. Provide a 21" pipe size for 4C to 413.
6. Revise the curb to be 10' from the south side of building K at the drive - through exit, to provide the
required 100' sight distance.
7. Move the dumpster currently shown next to building F to another location. Move it uphill, or on the
downhill side of the parking island. The inlet must be in the corner. The current location in the low
point of the topography is not acceptable, regardless of unreliable spot grades.
8. Provide drainage area maps for stormsewer computations. They were not provided.
Resubmittal fees are required for the WPO plans. $600 for this review. $600 when you resubmit.
B. Erosion Control Plan (WP0200800086)
1. State on the plan what you have done to meet proffer 7. I can find (1) early stabilization with gravel in
parking area, tackifier with seed on all slopes, (2) oversize sediment basin 3.
2. The first stage of construction must be to clean out existing and build or re -build the sediment basins.
The removal of sediment basin A appears to require diversion to basin 3. This must be shown on
plans.
3. The basin 3 areas are incorrect. By your map, the total area is 49.27 +6.72 +5.57 +other western area.
4. Remove the orifice at the bottom of basin 3.
5. Oversize the outlet structures to sediment basins 1 and 2 by at least one pipe size, to route larger
storms through to sediment basin 3.
6. I could not find anywhere that MS -19 has been addressed. I doubt that the channels across 29 are
adequate. A quick way to get past this issue would be to offer money or improvement to repair
downstream damage.
C. Stormwater Management and Mitigation Plan (WP0200800086)
1. The basin 3 routing must use SCS 24hr storm inflow distributions. My computations indicate

detention requirements are not met for the 10yr storm.
2. The `retention only' areas do not meet proffer 7. Filterras or stormfilters are recommended.
3. Routings must be provided for the biofilters. They were not provided.
4. Design must be provided for the Stormfilter. It was not provided. Size the stormfilter box to hold the
water quality volume.
5. Electric utilities must be removed from the basin. Note on the plan the power poles are to be removed
or moved.
6. A completed maintenance agreement must be provided before approval.

The final site plan for Hollymead Towncenter Al has been reviewed. The following comments are
provided:
The applicant will need an approved WPO plan before the final site plan is approved. At this
time, a WPO application has not yet been received. The applicant should prepare the WPO
plan to meet all conditions listed in ZMA proffer #7.
2. An analysis of the intersection of Connor's Drive and Towncenter Drive needs to be submitted
with this site plan. (ZMA proffer #5)
3. A public transportation stop needs to be shown in this site plan meeting the requirements
specified in the approved rezoning plan. (ZMA proffer #3)
4. The location and grading of the greenway trail need to be shown in this site plan, with
particular attention paid to the crossing of Meeting St.
A sidewalk Southwest of Building A is required. The ZMA showed a sidewalk in a curbed
island that was removed with this latest submittal.
6. A modification to the parking space standard needs to be approved by Zoning to allow for the
diamond - shaped tree island.
7. The site plan needs to be sealed, signed, and dated by a licensed professional. [ 18-32.6.1 ]
8. Please provide the date of the topography on the plan. [18- 32.6.6]
9. Show the two benchmarks on the plan. [DM]
10. The stream buffer is not shown on the plan. The label is on the plan, but not the buffer line.

11. Please specify which walls require a safety rail. [DM]
12. Guardrail is required on top of a wall adjacent to a parking or travel area. [18- 32.7.2]
13. Drainage easements are only needed on storm pipes carrying water from another parcel or
public ROW.

15. All drainage easements should be sized according to the formula specified in the design
manual. For example, the drainage easement along Route 29 is well undersized. [DM]
16. No trees or structures are allowed within drainage easements. [DM]
17. All entrances must be labeled with a VDOT designation. [18- 4.12.17]
18. The southeastern entrance does not have a landing that is less than 4% for the first 40ft. [18-
4.12.17]
19. Please show the necessary sight distance lines on the site plan and provide any sight easements
if needed. [DM]
20. VDOT approval is required. At this time, VDOT approval has not yet been received.
21. Please label all turn and taper lanes adjacent to site entrances.
22. The County Code requires that all internal site entrances keep 100ft sight distance. There
appears to be sight distance issues behind Building A, around the bank drive -thru, and from
the entrances onto Connor's Drive near sanitary manhole K. [18- 4.12.15]
23. It appears that CG -6 is provided on the plan but not labeled. [DM]
24. The dumpster behind building J needs to be moved or realigned. Considering the length of a
garbage truck, it appears this dumpster is inaccessible as drawn. [DM]
25. Parking areas exceed 5% grade in some places. For instance, the areas are round inlet 4 and
81 are over 5 %. Please check the remainder of the site for similar issues. [18- 4.12.15]
26. The sidewalk northeast of Building O needs to be widened to 6ft or bumper blocks need to be
placed in the parking spaces. The sidewalk is measured as 5.5ft wide. [18- 4.12.16]
27. Behind Building J, there appears to be a low spot in the pavement without a drainage
structure. Please correct so that there is no standing water on site.
28. The trash compactors behind building A will require a concrete pad. [DM]
29. Drainage cannot run across, through, or backwater in dumpster areas. It appears that this
occurs at the dumpsters northwest of building B, adjacent to inlet 63, and near inlet 42A.
Please correct. [ 18- 4.12.19]
30. Are the three separate parcels to remain or will the parcels be combined? If the parcels are to
remain then the following will be required: Connor's Drive needs to be designed as a private
road with a profile; access easements shown on all sidewalks and travelway aisles; parking
will need to work for each separate parcel unless parking agreements are signed between
property owners; drainage easements should be placed on the pipes carrying water from
upstream propertiesNDOT ROW. One property line travels through 3 different buildings. A
boundary line adjustment should be submitted or permission needs to be given from the

building official before the plan is approved.
31. Please show a stop sign from the site entrance onto Meeting St.
32. Please provide a street name sign at the intersection of Connor's Drive and Towncenter Dr.

33. Please provide a traffic generation and distribution summary for the entire site. [DM]
34. Show where each asphalt pavement section should be constructed on site. [DM]
35. Please add to the dumpster pad and sidewalk details that the concrete is to be "28 days or
stronger ". [DM]
36. Please provide typical retaining wall details that include any necessary safety rail or guardrail.

37. Please provide details for pipe outlets at biofilters that use a retaining wall as an endwall.
Drain profiles should be adjusted to match details /site plan. Details will also be needed for
retaining wall footers located directing over a storm drain pipe. [DM]
38. Please show access easements on the plan.
39. In the drainage profiles, please show a VDOT designation for each structure. [DM]
40. In the drainage profiles, please show the throat length for each curb inlet. [DM]
41. In the drainage profiles, please show the grate type for each drop inlet. [DM]
42. VDOT standard IS -1 is required on all structures where flow drops are 4ft or greater. This
includes drop from the surface to the bottom of the manhole. [DM]
43. In the drainage profiles, please show end - sections or end -walls at the end of all storm sewer
systems. [DM]
44. In the drainage profiles, please show the scour protection at the pipe outlets. This scour
protection should match the computations. [DM]
45. Please show structure 59 in the drainage profiles.
46. Please raise the elevation of the outlet pipes directing water into each biofilter to minimize
water backing up in the storm sewer system.
47. The invert of Inlet 30 is 3inches lower than the bed elevation. See previous comment.
48. Please include in this set the profile of the eastern storm sewer along Route 29.
49. Please accurately show the topography for pipe systems passing from or through biofilters and
under /through retaining walls. [DM]

50. Please provide storm pipe capacity calculations. [DM]
51. Spread calculations are not shown for all necessary inlets (92, 93, all curb cuts). All spreads
should be below 1Oft. [DM]
52. The curb inlet calculation table appears to be incorrect. Many of the slopes listed in the table
for gutter slope and pavement cross -slope do not match up with the grading as shown. Half of
the calculations do not include a gutter slope. Inlet 3 should be calculated as an inlet in a
sump condition, but the spreads from both the left and the right side need to be computed. A
full review of the curb inlet and spread calculations was not performed and additional
comments may be given on the resubmittal. Please refer to chapter 9 of the VDOT Drainage
Manual.
53. One hundred percent capture cannot be confirmed at the southeastern entrance because inlets
92 and 93 are not shown in the calculations. [DM]
54. Provide ditch computations for channels created in the parking lot to confirm that the spread is
below loft. [DM]
55. Inlets 7 and 22 are located on grade and not in sump conditions. Engineering review is
concerned that a considerable percentage of the design storm will bypass these inlets.
56. Provide outlet protection computations. [DM]
57. The grading and drainage area to the "curb cut at biofilter 4" does not appear to be correct.
Please clarify. [DM]
58. Please be sure to remove all temporary ESC pipes from the site plan. [DM]
59. Please show the work to extend the VDOT pipe at the southern entrance. A profile of this
system should be provided.
60. Grading in the northern corner of the site, adjacent to the roundabout, must be minimized. All
proposed grades in the parking lots, travelways, and roads surrounding the "Phase 2" area
must tie into existing contours as quickly as possible using 3:1 contours. Also, the wall along
Meeting St. should be reduced to the maximum extent possible and will need a determination
from the Planning Department whether a variation will be needed for the new wall (in the
place of Building N in the approved ZMA).

I have reviewed the site plan referenced above and offer the following comments:
Parallel spaces in front of Kohl's are an important feature which must be provided.
If the applicant wishes to remove the requirement for the spaces, the Zoning
Administrator must first determine that they are features that can be varied. If
such a determination is made, Planning can process the request; however, it is
unlikely that the request would be granted since they were requested as part of
the rezoning process and were important features
2. Sidewalks across the eastern most part of the site were shown on the Rt. 29 side
of the buildings on the application plan. They are now shown on the other side of
the building. The configuration of the sidewalks could be varied, if the Zoning
Administrator agrees that this kind of variation is possible. Such a variation would
likely be approved because sidewalks are provided on the western side of the
buildings that create pedestrian connectivity across the front of the site. The
applicant should just be aware of any pedestrian needs he might have for
maintenance of the part of the building that faces Rt. 29.
3. Please consult with Bill Fritz and Zoning on whether or not the applicant can
pursue final site plan approval without including the 5,000 square foot public plaza
on the northwest corner of the site. It is Planning's preference to see this area
built sooner rather than later since it is a key feature of the development.

The County of Albemarle Division of Zoning and Current Development will grant or recommend
approval of the final site plan referred to above once the following comments have been addressed:

!ACC section 32.5.61
A) The Final Prior to Preliminary Site Plan shall contain the following information.
• Zoning proffers and bonus factors applicable to the site including any: all special use permit
conditions: Show ZMA 2005 -015 and SP200S -27 on the site plan. i.e. ZMA and SP numbers.
proffers and conditions that apply to this area (Al) must be on the siteplan.
• Yard and building separation requirements. Consider a boundary line adjustment to bring all
the development under one parcel. The site plan shots boundary lines crossing along the
development.
B) Written schedules or data as necessary to demonstrate that the site can accommodate the
proposed use, including:
• Maximum number of employees. (Indicate on the site plan the proposed number of
employees).
• Schedule of parking including, maximum amount required and amount provided; Office
parking formula used instead of Retail. !Section 4.12 of ACCT. The parking calculation on
the siteplan uses the formula provided for office space. The development is mostly retail
with the exeption being the bank ihuiidin LK). Retail building formula based on square
footage should be used for the retail buildings. (Refer to the approved application plan and
the ACC section 4.12 for guidance)
• Parallel spaces shown next to building A on the application plan must he shown on this site
plan. (Refer to the application plan for ZMA2005 -15j
• Maximum amount of impervious cover on the site
• If a landscape plan is required. maximum amount of paved parking and vehicular circulation
areas. [Section 32 of .4CC1: Indicate on page C2 the maximum amount of paved parking and
vehicular circulation areas for the entire site.
C) If phasing is planned, phase tines and proposed timing of development.
• Is there a proposed timing of development fbr future phase 2? Proffer 11 requires that there he
additional public space constructed as a plaza area identified as "Plaza Amenity" on the
a p lieation plan_ of no less than 5000 square feet for thepurpose of public gathering and
passive outdoor recreation. [Refer to ZMA2005 -15 proffer #11 for further details].
D)

F) The name and location of all watercourses and other bodies of water adjacent to or on the site.
Indicate on the site plan the name of the water body (creek) adjacent to the site.
N) Location and dimensions of all existing and proposed improvements including:
• Sidewalks: Sidewalks and pedestrian crossings shown on the application plan are not shown on
the site plan. A sidewalk needs to be shown between building A and C along with the
corresponding cross walk. A sidewalk also needs to he shown on the north eastern most corner
of the site plan by the parking area adjacent to Building A. [Refer to the approved application
plan sheet A21
• Loading and service areas together with the proposed paving material types for all walks,
parking lots and driveways; and signs. [ACC Section 4.12.13 Loading Areas]: Indicate on the
site plan the loading area and truck route as shown on the application plan. Dumpster locations
for all buildings that are (4000) gross square feet or more. Buildings A, D, and E do not have
dumpster locations.
0) All areas intended to be dedicated or reserved for public use.
• ZMA2005 -15 Proffer Number 8. Indicate on the site plan land to he dedicated as Oreenwav to
Albemarle County. The land to be dedicated as .greenwav should be identified on the site plan

Q) Where deemed appropriate by the agent due to the intensity of development, estimated traffic
generation figures for the site based upon current Virginia Department of Transportation rates.

1. LightingiPhotometric Plan
A) Make sure light fixture location do not conflict with utilities and landscaping.
B) All light fixtures with 3,000 or more lumens must he full cut off. Provide cut sheets with
detailed evidence that the fixtures are full cut off. C) One label A fixture, and one label B2 fixture are missing, or show the location (plan is huge) I
may have missed them when counting.

D) Add the standard lighting note to the lighting plan. (Each outdoor luminaire equipped with a
lamp that emits 3.000 or more initial lumens shall he a full cutoff luminaire. The spillover of
lighting from luminaires onto public roads and property in the residential or rural areas zoning
districts shall not exceed one -half footcandle. "]
2. Landscape Plan
A) Acer rubrum "Karpick" is not on the plant list showing total canopy area. Let me know where
you found the 397 total canopy (SF) for this particular tree.
fi) QP Quercus phellos Willow Oak: 1 counted 107 of these on the site plan. I may have not seen
the one missing (plan is quite large) so please make sure they are 108 Willow Oaks and
indicate where they are located on the site plan..
C) LIT Lannestromia indica Tuskegee: has various symbols that so not match. Please use one
s.,Trthol that will make it easy to locate this tree on the site plan. There are more than 25 trees
with the LIT symbol.
D) PXJ Prunusx incamp Okame Cherry should have a height of at least 6' -7' to use the 99 (SF)
total canopy area shown on the canopy calculation. (refer to the approved plant canopy
calculations list found on the Albemarle County Site)
E) IAF Foster Holly: Has the same symbol as PO Serbian Spruce, Consider using a different
syrnbol for the foster holly. I could only count 10 foster hollies: this may be because several
other plants share almost the sarne symbol on the site plan. Please indicate where the rest of the
eight 8 foster Holly's are located.
f) PLOL Prunus Laurocerasus Otto Luuken: 1 counted 248 of these tress on the site plan. Please
show where the missing 33 are located on the site plan in case I missed them when counting.
G) CJ Crt ptomeria japonica I oshino: 1 counted 19, 13 missing, or show their location.
PI) PO Picea omorika Counted 47. 6 missing, or show their location.
Jasminum nudiflorum Hinter famine: None found. Missing or please show their location.

I have reviewed the site plan referenced above and offer the following comments:
1. Parallel spaces in front of Kohl's are an important feature which must be provided.
If the applicant wishes to remove the requirement for the spaces, the Zoning
Administrator must first determine that they are features that can be varied. If
such a determination is made, Planning can process the request; however, it is
unlikely that the request would be granted since they were requested as part of
the rezoning process and were important features
2. Sidewalks across the eastern most part of the site were shown on the Rt. 29 side
of the buildings on the application plan. They are now shown on the other side of
the building. The configuration of the sidewalks could be varied, if the Zoning
Administrator agrees that this kind of variation is possible. Such a variation would
likely be approved because sidewalks are provided on the western side of the
buildings that create pedestrian connectivity across the front of the site. The
applicant should just be aware of any pedestrian needs he might have for
maintenance of the part of the building that faces Rt. 29.
3. Please consult with Bill Fritz and Zoning on whether or not the applicant can
pursue final site plan approval without including the 5 square foot public plaza
on the northwest corner of the site. It is Planning preference to see this area
built sooner rather than later since it is a key feature of the development.

Over the last few days I was able to answer some the questions that we discussed at last week's SRC meeting.
Please see my responses below:
Curb Island Waiver
Ron Higgins from Zoning ok'ed the parking island configuration.
Sight distance around_ bank behind building A, and at the intersection to Conners drive
After looking at the plan again, it appears that the sight distance around Conner's Drive may not be as
problematic as it first looked. Please provide sight distance triagles to confirm that there are no obstructions of
sight lines in the next resubmittal.
The 100ft sight distance requirement behind Kohl's has been waived by the Zoning Department. For the sight
distance around the Kohl's loading area, I recommend that you still make some accommodations to make that
blind corner safer. For instance, if you striped /hatched the pavement in the area so that approach vehicles are
guided away (by 5 -10ft) from the corner it would provide more reaction time for vehicles in the area.
After looking more closely at the sight distance around the bank, it was noticed that the dimensions of this site
plan do not match those shown on the approved ZMA. Please match all dimensions of the approved ZMA
plan for the bank area. The sight distance requirement around the bank area will be waived by Zoning.
Drainage Easement along Route 29
This easement needs to be widen to the width required by the formula in the County's Design Manual.
Engineering review understands this area's importance to other agencies and will allow the landscaping as
proposed to remain in the easement. I have not yet been told how this requirement changes if Al does not add
water to this system. The requirement to widen the easement will remain a comment of mine, whether water from
Al is added to the pipe system or not, until I am told otherwise. The easement needs labelled as "dedicated to
public use" because it will convey water from a VDOT ROW.

2. An analysis of the intersection of Connor's Drive and Towncenter Drive needs to be submitted
with this site plan. (ZMA proffer 77.'5)
3. A public transportation stop needs to be shown in this site plan meeting the requirements
specified in the approved rezoning plan. (ZMA proffer 43)
4. The location and grading of the greenway trail need to he shown in this site plan, a ith
particular attention paid to the crossing of Meeting St.
5. A sidewalk Southwest of Building A is required. The ZNIA showed a sidewalk in a curbed
island that was removed with this latest submittal.
6. A modification to the parking space standard needs to he approved by Zoning to allow for the

full review of the curb inlet and spread calculations was not performed and additional

1 have reviewed the site plan referenced above and offer the following comments:
1. Parallel spaces in front of Kohl's are an important feature which must be provided.
If the applicant wishes to remove the requirement for the spaces, the Zoning
Administrator must first determine that they are features that can be varied. If
such a determination is made, Planning can process the request; however, it is
unlikely that the request would be granted since they were requested as part of
the rezoning process and were important features
2. Sidewalks across the eastern most part of the site were shown on the Rt. 29 side
of the buildings on the application plan. They are now shown on the other side of
the building. The configuration of the sidewalks could be varied, if the Zoning
Administrator agrees that this kind of variation is possible. Such a variation would
likely be approved because sidewalks are provided on the western side of the
buildings that create pedestrian connectivity across the front of the site. The
applicant should just be aware of any pedestrian needs he might have for
maintenance of the part of the building that faces Rt. 29.
3. Please consult with Bill Fritz and Zoning on whether or not the applicant can
pursue final site plan approval without including the 5 square foot public plaza
on the northwest corner of the site. It is Planning's preference to see this area
built sooner rather than later since it is a key feature of the development.
