Dear Mr. Manslow:
In the course of reviewing the Site Plan (SDP200700110) and the Special Use Permit (SP200700046)
applications we have found that the Site Plan application has been suspended and the Special Use Permit
application has expired on December 19, 2008 according to Albemarle County Code Section 32.2.4.2.2 (b)
because it was not acted on by the Planning Commission or Board of Supervisors within one year of the
request for indefinite deferral.
On Wednesday, December 19, 2007, I sent via e -mail to Mr. Terrence Donohue, of your firm, and Ms.
Tracy Doub, of BB &T, notification that your submittal was incomplete and staff would recommend denial
to the Planning Commission based upon an incomplete submittal and that you may wish to consider
deferral. In response, Mr. Terrence Donohue of Security Vault Works sent an e -mail to my attention
requesting indefinite deferral of these two applications. Both applications were considered to be
indefinitely deferred at that time.
The County had not received indication to reopen these applications by addressing previous comments
from the Department of Community Development or the Architectural Review Board by resubmitting any
documentation until your letter received January 29`h, 2009.
Therefore, County Code Section 31.2.4.2.2 provides that Use Permits deferred for twelve (12) months shall
also "be considered voluntarily withdrawn." You must re -apply for an Amendment to an existing Special
Use Permit with the requisite documentation and fee.
In order for the Site Plan to become active again, you must:
• address all the comments from the Department of Community Development, the Architectural
Review Board, and the Virginia Department of Transportation previously sent to you;
• revise and resubmit the site plan;
• pay the $65.00 fee to reopen the Site Plan application.

Re: Proposed ATM Addition at BB &T Bank Location at 1425 Seminole Trail
Mr. Lawrence,
Per our conversation in October of 2008, we are responding to the Albemarle County
reviewers' comments as follows:
Regarding Judy Wiegland's memo of 10/26/07, BB &T's will not pursue an inter - parcel
connector at this time.
Regarding Amelia McCulley's memo of 11/14/07, please note. the following:
1. There is over 19' of clearance at the narrowest point between the island and the
brick retaining wall. So there will be room for a 10' bypass.
2. There will be sufficient stacking space for the new outer ATM lane for 5 cars.
3. Average use time of a drive up ATM is less than 2 minutes.
Regarding David Ekern's comments,
1. The site distance on the existing entrance to Rt. 678 is adequate.
2. If the road and drainage plans are available in the public domain, they will be
submitted with the site plan.
3. The width of the parking spaces is 10' according to the site plan.
4. Maneuverability for truck traffic will remain the same and be adequate.
Regarding Brent Nelson's comments,
1. The proposed ATM Kiosk is not a passive piece of mechanical equipment such as
a heat pump. It is meant to be visible to customers and is lit for safety and ease -
of -use purposes.
