Re: Zoning Clearance for Rivanna Quarry (CLE 2009 -19)
Dear Mr. Hurt,
The purpose of this letter is to summarize the conditions that must be met before the
permit can be issued for this use. In accordance with Section 30.4.03 of the Zoning
Ordinance, this use may not lawfully begin until a permit has been issued by the Zoning
Administrator. For our administrative purposes, we are listing this permit as a zoning
clearance and it is CLE #2009 -19.
The relevant zoning regulations to this permit requirement follows:
30.4.03 PERMIT REQUIRED
Prior to commencing any natural resource extraction activity within any NR district, the operator
of such activity shall obtain a permit therefor from the zoning administrator. Such permit shall be
issued upon filing with the zoning administrator of a plan of the proposed natural resource
extractive activity, including all data sufficient to ensure compliance with the provisions of this
section. The applicant may comply herewith by the filing of a copy of any plan of such proposed
operation approved by the Virginia Department of Conservation and Economic Development filed
pursuant to Title 45.1 of the Code, together with such additional data as the zoning administrator
may require to ensure compliance with this section. In addition, the applicant shall provide
evidence satisfactory to the zoning administrator that he has complied with the provisions of Title
45.1 of the Code. Every such permit issued by the zoning administrator shall be subject to annual
review and shall be revoked in the event that any permit issued for any such operation shall expire
or otherwise terminate in accordance with the requirements of Title 45.1 of the Code or the
regulations of the Virginia Department of Conservation and Economic Development. (Amended
4- 28 -82)
A site plan is not required for this use to commence because it is exempt from that
requirement per Section 32.2.1 e. The Virginia Department of Transportation's letter
dated June 16, 2008 states that the existing entrance serving this use is already
adequate. In addition, sufficient parking currently exists on the Stackhouse property.
Therefore additional parking is not required by the Ordinance.

The permit to allow the quarry use will not be issued until the following conditions have
been met:
1. County Engineer approval of a certified engineer's report confirming compliance
with the applicable performance standards;
2. Albemarle County Fire / Rescue approval of / permit for the temporary storage of
explosives onsite:
3. Federal Bureau of Alcohol, Tobacco and Firearms approval of / permit for the
temporary storage of explosives onsite;
4. Submit a quarry plan revised as follows:
a. Delete "quarry use" reference for parcel 59A1 and road extension to that
property;
b. Delete "quarry use" reference for parcel 70;
C. Note the old southern entrance is not approved for quarry use;
d. Clarify with notes on the plan what the "existing screening berm and
dense vegetation" consists of;
e. (Section 30.4.06 Yard and Bldg Locations) - show any dwellings on
adjoining property within 200 ft of this property line. Your plan proposes a
200 ft buffer from the property line for this use. How will it be tied down on
the ground?
f. Note that 35 parking spaces will be made available on TM 45, parcel 58 to
serve this use;
g. Note on plan that this use is subject to the requirements of Section 30.4
Natural Resource Overlay District;
h. (Section 30.4.07 Fencing) Clarify the height of fencing as well as what is
proposed versus existing;
i. Clarify which if any road surfaces are not yet complete per Section
30.4.11.2;
5. Any items which are not yet complete (such as screening, fencing or required
road surface and the like) must be completed.
With regards to items #2 and 3, please provide a copy for our file of those permits or
written exemptions from the permit requirement. For item #4, please submit a revised
plan addressing items a -i. Please provide information relating to #5. We will conduct a
site inspection to confirm the required items are complete.
