A. General Review Comments
It appears that this construction is very near, or possibly in, an existing stream buffer. Disturbance
within a stream buffer (including earthwork, tree removal, addition of structures) may only be
authorized by the County Engineer under Section 17 -321 of the Water Protection Ordinance. If
development is anticipated within the stream buffer, please submit an application for Request to
Develop in a Stream Buffer to the Community Development Department. If development in the
stream buffer is authorized, mitigation will be required.
REV 1: New measurements submitted by the applicant show that the potential stream buffer
disturbance occurred in an area of a power line easement. Tree plantings for mitigation are not
allowed in such an easement and are therefore not required. The area has been stabilized and
reseeded.
B. ESC Plan Review Comments
1. The Erosion & Sediment Control Plan can not be approved until the matter of stream
buffer disturbance is resolved.

2. Please provide the Erosion & Sediment Control Plan (E &SC Plan) at a measurable scale.

3. Please add existing topography and existing stream buffers to the E &SC Plan. These
features can be found on the County GIS website.

5. A construction entrance (per Standard & Specification 3.02 of the Virginia Erosion &
Sediment Control Handbook) is required on the existing driveway.
REV 1: Site is stabilized and no further construction is to take place, a construction entrance
is not required.
The Erosion & Sediment Control Plan (WP0200800107) has received Engineering Review and
meets Albemarle County minimum checklist items for approval.
The applicant must post a bond to ensure that the site remains properly stabilized until permanent
vegetation has matured. The E &SC bond amount is $500.00. The forms and instructions to
post the Water Protection Ordinance Bond can be found on the Community Development
Department Web site on www.albemarle.org.

Once the E &SC bond has been posted, you may contact the County Erosion & Sediment Control
Inspector to close -out the violation.
