The applicant has requested a waiver of the County Code section 14 -404 requirements for the new
construction proposed on TMP 72 -54. This request is being reviewed in conjunction with the preliminary
plat, rev. date 26 October 2007. The current lot and road layout is virtually the same as when this waiver
was approved in January of last year. The only difference is now a portion of the preservation tract is now
on the north side of Route 637.
The engineering analysis of the requests is as follows:
Waiver of the requirement of County Code section 14 -404:
This section of the Code states that "each lot, other than a corner lot within the development areas, shall
have reasonable access to the building site from only one street, shared driveway or alley established at the
same time as the subdivision."
The proposed preservation tract, Lot 15, is separated from the other lots and proposed internal public
streets by existing State Route 637, Dick Woods Road. It is not possible for this preservation lot to access
the proposed internal public streets because of the existing conditions.
Engineering recommends approval to the waiver of County Code section 14-404 to allow access to the
preservation tract Lot 15 from State Route 689, Pounding Creek Road. A mitigation plan for the stream
crossing will be reviewed and approved before the building permit is issued for the preservation tract to
comply with latest changes to the Water Protection Ordinance.
