150, and in which the interest of Claire S. Zoulis was conveyed to

property, join in the execution of this deed to evidence their
request to the Grantor that this conveyance be made to the
Grantee.

This is a part of the land which was conveyed to Reuben Sprouse,
Sr., now deceased, by deed of M. M. Smith and others, dated October 1, 1909,
and recorded in the Clerk's Office of the Circuit Court of Albemarle County,
Virginia, in Deed Book 142, page 296, the said Reuben Sprouse, Sr., having
died testate, leaving his widow, Martha Elizabeth Sprouse, who has since died,
and the title to said land is now vested in the said Reuben Sprouse, Jr.,
under and by virtue of the terms of the will of the said Reuben Sprouse, Sr.,
which is spread in Will Book 35, page 402, of said Clerk's Office.
Reference is hereby made to said plat and will and deed and
references therein made for a more complete description of the real estate
hereby conveyed.
The said parties of the first part reserve for themselves,
their heirs and assigns, the right to take and use water for domestic _
purposes from the spring located on the tract of land hereinabove described
and conveyed, with the right of ingress and egress to and from said spring
as presently used, along with others who may have the right to take and use
water from said spring as now exercised.
As appurtenant to the tract of land hereby conveyed, the
said parties of the first part hereby GRANT unto the said Willard H.
Birckhead and Frances B. Birckhead, upon the limitation as aforesaid, the
right but not the exclusive right, to use the present roadway or outlet to
U. S. Highway No. 29 shown on said plat.
The said Reuben Sprouse, Jr., covenants, subject to the foregoing
that he is seised in fee simple of said land and with his wife has good right
to convey the same; that he has done no act to encumber said land; that the

Grantees shall have quiet possession of said land, free from liens and all
encumbrances, and that they, the said parties of the first part, will execute
such other and further assurances thereof as may be requisite.

That for and in consideration of the sum of Five
Hundred Six and No/100 Dollars (3506.00) cash in hand paid by
the GRAMES to the GRANTORS, the receipt of which is hereby
acknowledged by the GRANTORS, the GRANTORS do hereby GRAITT,
BARGAIN, SELL and CONVEY with GENERAL WARRANTY of TITLE unto
the GRANTEES as tenants by the entirety with full rights of

survivorship as at common law and not as tenants in common,
the following described property:
That certain parcel of land comprising 2.53 acres,
more or less, situate in the Rivanna ITagisterial District of
Albemarle County, Virginia about four miles north of the City
of Charlottesville and designated as Parcel "I" on a plat made
by Thomas D. Blue, C.E., dated August 13, 1969, attached hereto
as a part of this deed and being a portion of the land which
was conveyed to Reuben Sprouse, Sr., now deceased, by deed from
M. M. Smith, et al, dated October 1, 1909 and recorded in the
Clerk's Office of the Circuit Court of Albemarle County, Vir-
ginia in Deed Book 142, page 296. The said Reuben Sprouse, Sr.
died testate, leaving his widow, Martha Elizabeth Sprouse, who
has since died, and the title to said land is now vested in the
said Reuben Sprouse, Jr. under and by virtue of the terms of
the will of the said Reuben Sprouse, Sr. dated February 3, 1935
and probated February 12, 1935 in,the aforesaid Clerk's Office
and spread therein in Will Book 35, page 402.

This conveyance is made subject to existing road as
shown on the aforesaid attached plat and further described in
instrument recorded in the aforesaid Clerk's Office in Deed
Book 426, page 96 and the said GRANTORS further GRANT and CON
VEY unto the said GRANTEES, asappurtenant hereto, a nonexclusive
right of way over said existing road to U.S. Highway 29..
Reference is made to said plat, will and deed and
other references for a more particular description of said land
and easement.
Subject to said existing road, the said GRANTORS
covenant that they have the right to convey the aforesaid land
to the aforesaid GRANTEES; that the aforesaid GRANTEES shall
have quiet possession of the said land, free from all encum-
brances; that they have done no act to encumber the said land;
and that they will execute such further assurances of said land
as may be requisite.
