ATTACHMENTS: Yes STAFF CONTACT(S): REVIEWED BY: VWC Margaret Doherty BACKGROUND: Pursuant to Section 4.12.4, required parking maybe provided cooperatively for two or more uses in a development, subject to arrangements that will assure the permanent availability of such space as such arrangements are approved by the commission. The amount of such combined space shall be equal to the sum of the amounts required for the separate uses; provided,that the commission may reduce the amount of space required for multiple uses under the provisions of a combined parking area by reason of different hours of normal activity. DISCUSSION: The property owner and manager of Greenbrier Square shopping center,the applicant, has submitted a detailed analysis of the many uses within the development and their parking demand (see Attachment B). In order to allow a restaurant use to occupy a vacant storefront, the applicant has allocated specific numbers of parking spaces to each existing use in the development. Further,the uses are arranged such that some uses only demand parking spaces during the day, while others demand parking during the day and the evening. This allows for the availability of 63 parking spaces, to be cooperatively shared during the evening hours, when only 29 will be needed to serve those uses open in the evening. The Zoning Department has reviewed the analysis and agrees with the parking allocation strategy. Therefore, the applicant requests approval of the cooperative parking arrangement as described in the letter dated January 13, 2002, in order to allow another restaurant within the development. RECOMMENDATION: Staff finds that the proposed parking arrangement meets the intent and purpose of Section 4.12.4 and _ recommends approval of the cooperative parking strategy as proposed in a letter from the applicant, dated January 13, 2003, subject to the following conditions. 1. A physical demarcation must be provided that clearly identifies the area that may be open before 5 o'clock p.m. and the area that may be open after 5 o'clock p.m; and 2. The cooperative parking agreement, based on the letter from the applicant, dated January 13, 2003, must be signed by the property owner,the property manager and the current tenants of the development. I have attached a copy of a September 19, 200 i Parking Analysis prepared by John Grady of the Zoning Department, and I have verified that his analysis is correct. I have also enclosed four copies of the September 3, 1985 "as built" site plan. While it is not relevant to the current issue, I note that the dumpster pad is new not in the location shown on the site plan at the southwest corner of the smaller building, but ,s at the southeast corner of the smaller building fin the loading area behind the two buildings). Two dumpsters are provided in that location and an additional dumpster is provided in the location shown on the site plan in the north corner of the property. The cooperative parking request involves the following tenants. The restaurant (shown ' on Mr. Grady's analysis as "Tacos"but now named "El Rey Del Taco") occupies 1454 square feet in the area shown on the site plan as retail/office, immediately west of the dance studio. That restaurant wants to expand into adjacent space identified on Mr. Grady's analysis as "MAS" , comprising 4806 square feet, and being to the west of the space it presently occupies. The restaurant presently has 19 spaces allocated to it, and the MAS space has 19 spaces. Accoiding to Mr. Grady's calculations, with which I agree, there were 16 extra spaces on the site. which can be allocated to the restaurant. Thus, at the present there are 19 (existing Tacos) 19 (MAS) + 16 (extra spaces) or 54 spaces. That will support(at 13 spaces per 1000 gross square feet.of restaurant) 4,153 square feet of restaurant. The restaurant operator intends (and will agree by lease restriction) to configure the interior so that it will open not more than 3,700 square feet of restaurant before 5 o'clock p.m. The expanded restaurant (for operations after 5 o'clock p.m.) will require allocation of a total of 82 spaces (4806 + 1494 square feet= 6300 square feet; require 13 spaces per 1,000 square feet, or 82 spaces).As shown above 54 are provided or available. T propose that , 3 ATTACHMENT B cooperative parking be provided as to the other 29 spaces needed. Of the tenants shown on Mr. Grady's analysis, only Dance Studio (5 spaces), Emergency Vet(2 spaces), and Sunshine Laundry(22 spaces) are open after 5 o'clock p.m. Thus, 63 spaces are available for cooperative or shared parking but only 29 are needed.
