After reading this report, I am not reassured that this use will meet the performance standards of the Zoning Ordinance. The engineer has simply stated that, based on what his client has told him, he opines that they can meet the ordinance. I found no specific information regarding the proposed operation, its location on -site, its hours of operation, storage of materials, trucking of materials, maintenance of equipment, parking, safety measures and precautions for the operation, etc. There has been no testing on -site for noise, vibration, or glare concerns. This report contains only cursory statements based on un -cited references. Without measurements taken, noise, vibration, and glare are likely to be concerns. Water pollution and erosion issues on -site, both with existing areas and new operations do not appear to have been addressed. Rev. 1: Updated comments on revised report of 5 -4 -09 by Timothy Miller The updated report has been reviewed. I could find three new areas of prose in the updated report. Each of these promises to do testing for compliance at a later time; Noise: "Each time a new type of mobile rock crushing plant is brought to the property, the operator of the quarry will conduct a noise study..." Vibration: "...contractors will test for vibrations prior to the commencement of rock extraction..." Glare: "Upon the relocation of a mobile plant to the site, the quarry operator will observe for glare, and invite county inspectors out..." It is my suggestion that this certified engineer's report be considered a phase 1 report, and conditionally approved based upon a satisfactory phase 2. The phase 2 report shall be submitted to the county within 30 days of commencement of the operation, and shall contain the noise and vibration measurements and data cited in this report, with an engineer's analysis for compliance and a seal. file: E2_cer_GEB_RivannaQuarry.doc
