HomeMy WebLinkAboutSP200900018 Review Comments Special Use Permit 2009-07-01 (2)�� OF ALg� County of Albemarle Department of Community Development Memorandum To: Scott Clark, Senior Planner From: Sherri Proctor, Senior Permit Planner Division: Zoning Date: June 23, 2009 Subject: SP- 2009 -18 The Children's Garden Preschool I have reviewed the application and now offer these comments: This use will be subject to the supplemental regulations of Section 5.1.06 which are provided here for your reference. 5.1.06 DAY CARE CENTER, FAMILY DAY HOME Each day care center or family day home shall be subject to the following: (Added 10 -3 -01) a. No such use shall operate without the required licensure by the Virginia Department of Social Services. It shall be the responsibility of the owner /operator to transmit to the zoning administrator a copy of the original license. Failure to do so shall be deemed willful noncompliance with the provisions of this chapter; (Amended 10 -3 -01) b. Periodic inspection of the premises shall be made by the Albemarle County fire official at his discretion. Failure to promptly admit the fire official for such inspection shall be deemed willful noncompliance with the provisions of this chapter; (Amended 10 -3 -01) c. These provisions are supplementary and nothing stated herein shall be deemed to preclude application of the requirements of the Virginia Department of Social Services, Virginia Department of Health, Virginia State Fire Marshal, or any other local, state or federal agency. (Amended 10 -3 -01) The use is also subject to the following parking requirements. Day care center, nursery facilities: One (1) space per ten (10) children enrolled in the major class or shift plus one (1) space per employee. In addition, a pick -up and drop -off area shall be provided on the site. (Amended 2 -5 -03) According to the information provided by the applicant, the maximum number of children enrolled will be 7, with one (1) employee on site, requiring a total of two parking spaces. As this use is being conducted at the home of the "employee ", the 2nd parking space is counted in the required parking for a single family dwelling. For the daycare and dwelling the total required parking is three (3) spaces. The site is adequate to accommodate the required parking and pick up /drop off area for this use. Should the entrance be adequate for VDOT requirements and given that the site does not require additional parking, a site plan is not required. Applicable standard conditions for Day Care Centers should be considered.
