The Zoning & Current Development Division of the Albemarle County Department of Community
Development will approve the plat referenced above when the following items have been satisfactorily
addressed. The following comments are those that have been identified at this time. Additional comments or
conditions may be added or eliminated based on further review. [Each comment is preceded by the applicable
reference to the Albemarle County Code.]
[Sec. 14- 302A.5] Public easements; [Sec. 14- 302A.101 Right of further division of proposed lots.
COMMENT: After further review of the development rights note listed on the plat, and in light of the
application of the (ACE) conservation easement, the County requests that the note be revised to clearly
list and assign ALL development rights that are in place, regardless of whether they are usable due to
the conservation easements. A copy of a December 30, 2004 Letter of Determination has been faxed to
your office to assist you in the assignment of development rights.
