County of Albemarle Department of Community Development Memorandum To: Tucker Hurt, Virginia Land Company From: Amelia McCulley, Zoning Administrator Division: Zoning Date: June 19, 2009 Subject: CLE 2009 -019 Rivanna Quarry With the submittal of minor plan revisions and our confirmation of road surfacing and parking delineation, we will be in a position to grant conditional approval of this zoning clearance. Please consider the following comments: 1. Inform us when the road surfacing and parking delineation have been completed so we can conduct a field inspection to confirm and approve this condition; 2. Please confirm that the zoning clearance fee of $35 has been paid. If it has not, please pay the fee; 3. Please provide the following revisions to the plan: a. Either state or clearly show that the fencing completely surrounds the extraction area. It is not clear that the fence exists along the northeastern portion of the extraction area adjacent to the access road (Zoning Ordinance Section 30.4.07); As the County Engineer noted in his review comments dated June 3rd, the certified engineer's report is lacking in actual testing measurement data. Please be advised that (despite the statement in the engineer's report) that the noise standards of Section 4.18 also apply to this activity except as superseded by certain standards within Section 30.4. Therefore, the general noise standards are 60 decibel maximum day and 55 decibel maximum night. Once granted, this conditional approval will be based on the submittal of a phase 2 engineering report that shall contain the noise and vibration measurements with an engineer's seal and analysis for compliance. Failure to submit this information within 30 days of commencement of this operation will result in revocation of the zoning clearance approval. Cc: Glenn Brooks
