RE: Request, originally dated December 22, 2008, for variation from the approved
application plan for ZMA 2004 -0024 Old Trail
Dear Mr. Collins:
The referenced variation is being requested in association with Old Trail Village Block 2
Preliminary Site Plan, Sheet 3 of 6, prepared by Collins Engineering, revised May 6,
2009. The site plan includes: the elimination of a portion of Brookley Drive which is
replaced with a multi - purpose path; a combination of a multifamily (elderly congregate
care) residential facility, a rest home, and a 3 - story, 10,500 sq. ft. commercial office
building; and parking for the uses in Block 2.
This request is for a variation to street design, further described as the elimination of a
portion of Brookley Drive as approved on the rezoning plan. This letter serves to provide
approval of this variation. With the approved rezoning, a variety of uses were allowed in
Block 2, but specific uses were not determined at that time. The applicant has now
determined the specific uses (noted above) for Block 2 with a specific design and site
layout. As a result, a portion of Brookley Drive is eliminated in order to obtain this
proposed layout and required parking.
The analysis of the variation request is provided below.
Section 8.5.5.3 allows the director of planning to grant minor variations from the
approved plan as long as:
1) The variation is consistent with the goals and objectives of the
comprehensive plan.

the eliminated portion of Brookley Drive is proposed to instead be a multi-
purpose trail connecting to.sidewalks that access an adjacent proposed public
park.

intensity of development.

The multifamily facility and the nursing home creating the need to eliminate
Brookley Drive provide development in a mixed use environment that is within
the maximum dwelling units and gross density specified in the code of
development for mixed use.
:3) The variation does not adversely affect -the -timing . and-phasing of
development of any other development in1he.zoning district.
The variation does .not affect any timing or phasing of this or -any other
development.
-4) The variation does not require a special .use permit.

5) The variation is in general accord with the purpose and intent of the
approved rezoning application.
The variation is in general accord with the purpose and intent of the approved
rezoning. The development resulting from the variation continues to provide a
mixture of uses, interconnections, relegated parking and a pedestrian friendly
environment in Old Trail Village.
