Unfortunately, this mistake is a violation of Section 14 — 103 of the Subdivision Code of Albemarle County. On September 30, 2008, application number SUB2008- 00180, an agent of the County signed and approved a boundary line adjustment plat of the above listed parcels for recordation. The application process was complete and the file was closed at that time. On June 16, 2009, I received an electronic copy from your office of a boundary line adjustment plat of the same parcels listed above with the recording information included, Deed Book 3721 Page 703, but without County approval. This plat has not been through the application process required by Albemarle County Code. Granted, the plats are similar and the property is the same. It's understandable how a mistake can occur. Much more information has been added to the plat I received June 16ffi and it remains to be reviewed and approved by an agent of the County. The remedy for this error is easily accomplished. Simply re -apply for the boundary line adjustment, including the fee. We can review it and, barring any changes that need to be made, quickly approve it. The plat must be reviewed to be approved to comply with the Subdivision Code. At this time we are taking no formal action to pursue this Subdivision Violation as it appears to be a simple error. However, if the matter is not addressed in a timely manner we will officially notify the owners of the parcels affected by the recorded plat that a violation exist and we will take the appropriate measures to cause the violation to be correct.
