The application proposes -a 438 square-foot addition on'the exiting site. This application will amend the special use permit conditions -found in .SP- 90 -:19 Multi- channel Television on'Tax Map 45, Parcel :16A. The information provided with your initial application for a - Special Use Permit has been reviewed bythe_Department of Community Development, including the Planning Division and the.zoning and Current"Development Division. The County :Engineer, Albemarle County .Service Authority, Rivanna Water and Sewer Authority, and -the Fire /Rescue .Department, have also reviewed the.project. Comments are also expected from-the Virginia Dept. of Transportation and will.be forwarded as soon as -they are-received. Comments from reviewers are summarized below. .Conformity with•the,Comorehensive Plan: The Comprehensive Plan designates the subject property Rural Area in Rural Area :1, which allows-for unmanned telephone exchange centers in the Rural Areas:District.by special use permit. The requested special use permit is consistent with this.designation and will amend previous .special use permit conditions. Neighborhood 'Model: This special use permit-request is - forthe- expansion of an existing 720.square foot.building. The applicant is proposing a -438 Square -foot addition` to -house -more - electronic - equipment -needed to keep .up with consumer demand. This request does not need -a Neighborhood - model analysistherefore;:a Neighborhood'Model -analysis °has -not been done. .Staff :Comments The site at 1658 Earlysville Road is currently owned :by Cable Holdco Exchan -ge V LLC'and is an unmanned communications facility that houses equipment used for number of communications services including high definition channels, high _speed internet, Comcast digital voice, and video on demand..Due to .growth in consumer needs, Comcast - - -( communications provider) needs -to add additional -electronic - equipmentto keep up -with - - - - - - -- — consumer demand. SP .2009-021, Comcast Facility Expansion, Michael Welch, :September 4, 2009 2 Staff's primary questions /concerns with-this Special Use Permit relate to the Storage trailer .and cable spools that.are currently on site. -Staff has-found that-there was a violation on the site at which time it was determined that the storage'trailer and the cable spools would be removed -from the site..Staff wishes-to -revisit this request. The applicant must remove the - existing storage trailer and cable spools before the special use permit can be approved. Additionally, 'the special use _permit concept plan must include:a cover sheet with site data descriptions /site-facts. Previous special use permit conditions must be scanned onto-the concept-plan and the magisterial district, county, and.state.added -tothe concept -plan.There also needs -to:be -and existing conditions page and a proposed expansion page that would help identify-the before and after conditions. Please remove-the reference -to SP :1991-29. SP.1991-29 is a special use permit for a miniature -golf course on Tax,Map -45 parcel 1:1:2C1. Please note-that -all .zoning district minimum setbacks must be met. Water.and` sewer: Both the Rivanna Water &Sewer Authority and the Albemarle County Service Authority have reviewed -this application. Based on -their-reviews, -there is no water or.sewer issue anticipated with the proposed expansion. `Special :Use'Permit' Conditions. There have been other special use permits approved for -this site. SP =79 -32 and .SP- 90 --19. SP -90 -19 amended the conditions found in SP- 79-32. As noted above, :please add the special use permit conditions ,found in-SP-90-19 to the concept plan. Resubmittal. When you are ready-to resubmit, please provide that resubmittal on a resubmittal Monday (see attached schedule). Make sure-to put my name on the cover page of your resubmittal. After you have resubmitted, staff will provide -a set of written comments for your review prior-to setting a public hearing before the Planning Commission. In those comments, we will advise you as to whether all substantive issues have _been resolved or if additional resolution is needed. A public hearing with the Planning Commission will not be advertised until you advise us that-the project is ready-to proceed-to a public hearing. Atthat-time, the legal .advertisement will be run in the newspaper and a staff-report will .be .-prepared-to go-to - the Planning Commission. - Please be advised that, once -a.public hearing has-been advertised, only one deferral prior-to -the-Planning Commission's --public hearing will be allowed during -the life of the -application. The only•exception*to this rule will.be extraordinary circumstances, such as a major change in the :project proposal .by the applicant or more issues identified by staff that were -not previously.brought-to the applicant's attention. If changes needed are minor, the planner will advise that the project go to public hearing. ** The legal ad deadline is the last date at which an applicant can decide whether to resubmit or go to public hearing. If an applicant decides to go to public hearing against the advice of the reviewing planner, a recommendation for denial will likely result. Generally, the applicant will will have only one opportunity to defer the PC public hearing for the project once it has been advertised for public hearing.
