Listed below are some comments based on a review of the Biscuit Run Connector Road & Phases A & D — SWM and E& S Plan, as we have previously discussed. If it would be helpful, I can also supply the map that I worked from to develop these comments. During the rezoning, and as described in the Code of Development: "Conservation and Preservation areas have been delineated in the General Development Plan. These areas are comprised of the greenway, passive recreation areas and buffers. Conservation Areas consist of areas which may contain natural features such as non -tidal wetlands, floodplain, slopes identified in the open space element of the Comprehensive Plan, or streams and stream buffers, within which only limited disturbance or development is allowed. Disturbances that may occur within conservation areas include construction and maintenance activities associated with utilities, trails, streets, stormwater management facilities and erosion and sediment control measures, and similar uses of similar impact. Preservation Areas consist of areas which contain natural features such as non -tidal wetlands, floodplain, streams and stream buffers that are to be preserved in a natural state and not be developed with any manmade feature, other than trails. Tree preservation measures described in Appendices A and B shall apply to Conservation and Preservation areas. " Exhibit 3 of the approved plans is the preservation and conservation plan. In the applicant's recent WPO submittal, Blocks 5, 6, 8 & 1 show conservation and preservation areas that appear to be disturbed by proposed grading. Per the language, as noted above, in the Code of Development, staff does not recommend disturbance of these areas. In particular, and as stated above, the preservation areas are to be preserved, and should not be disturbed/developed with any manmade feature, other than trails. 2. The submitted plan for WPO 2009 -00014 shows two facilities that significantly impact the buffer along Route 20, and one facility includes grading adjacent to the buffer. The buffer is an important element of the proposed development, meant to provide an appropriate appearance for the development along the Entrance Corridor. The proposed buffer disturbance is expected to negatively impact the Entrance Corridor. The buffer disturbance needs to be minimized to the greatest extent possible. One suggestion is lowering road AA in the area closest to the future connector might be pursued as one option for limiting impacts to the buffer. The following comment is primarily for your information, for future use: The Code of Development for Biscuit Run describes parks in the following manner: "Parks are dispersed throughout Biscuit Run, as shown on the General Development Plan, to provide easily accessible active green areas. These informal spaces have different characteristics due to their placement and configuration. While primarily open lawn, these spaces can accommodate additional garden elements such as planting beds, lawn panels, benches, and ornamental flowering trees. They also may accommodate various public functions and gatherings, as well as informal recreational activities such as reading, throwing a Frisbee, or walking a dog. Parks such as the long, narrow parks located between blocks 4 & 5 by the South Mill Creek Connector, as described above, and in the Code of Development are expected to be usable, active green areas.
