Subject: SUB - 2009 -119- The Powell Property- Family Division
The Planner for the Zoning & Current Development Division of the Albemarle County
Department Community Development will recommend approve the plan referred to above when
the following items have been satisfactorily addressed. (The following comments are those that
have been identified at this time. Additional comments or conditions may be added or eliminated
based on further review.) [Each comment is preceded by the applicable reference to the
Albemarle County Code.]
1. [14- 302(A)(10)] Right of further division of proposed lots. Note #4 states that `Lot X is
assigned 0 (zero) development rights and may not be further divided.' However, Lox X
needs to be assigned one (1) development right. Revise note to designate a development
right to Lot X.
2. [14- 303(N); 14- 235(B)] Statement pertaining to private streets. Provide the following
statement as a notation on the plat: "The streets in this subdivision may not meet the
standards for acceptance into the secondary system of state highways and will not be
maintained by the Virginia Department of Transportation or the County of Albemarle."
3. [14 -211; 14- 212(A)] Verification of Family Division. Provide a copy of an affidavit,
deed, or letter from attorney stating: grantee, grantor and their relationship; and certifying
that this is a Family Division in accordance with Section 14 -208 and related provisions of
the Albemarle County Code. At template has been provided for your use.
4. [14- 212(B); 14 -316] Approval of entrance onto public streets. All entrances must be
approved by the Virginia Department of Transportation. Provide a letter stating such
compliance and approval.
5. [14- 308.1] Groundwater assessment information. A $275 fee for the groundwater
assessment is required.
6. [14 -309; 14 -310; 14 -4161 Soil evaluations. Health director approval of individual private
wells and/or septic systems. Individual private wells and septic systems. Provide the
results of percolation tests or other methods of soil evaluation used to determine the
suitability of the soil for septic systems with conventional drain fields, so that the agent
can then forward them onto the health department for review and approval.
