Hugs & Kisses Dog Care — 2nd Zoning Comments I have no objections to this request. Please consider the following (that we have discussed) as you draft conditions of approval: 1. Please do not regulate the days /times the facility is closed, unless there is a clear land use or policy purpose for doing so. I cannot identify any purposes. 2. Please do no require that the dogs be special needs, unless there is a clear land use or policy purpose for doing so. I cannot identify any purposes. 3. For the hours of operation, please state "not earlier than" and "not later than." Please consider allowing the hours to extend past 2 pm. 4. Please consider a condition establishing a maximum number of dogs for this use on this property. Because of the nature of this proposal, it is not possible to utilize a typical condition (such as kennel size) for limiting the intensity of this use. For the waivers that are under review, please make certain the record clearly indicates what the waiver is and the action that is taken. For example, if the required minimum distances to the RA property lines are not met, please state (in the staff report) the distances to these property lines. With regards to Section 5. 1.11 a, the request is for fencing that is not "solid" and "composed of concrete block, brick." It appears that the sound - related request is not an actual waiver or modification of the maximum decibel level. The requirement in Section 5.1.11 c for animal confinement at night will be met based on their proposal. Therefore, a waiver of that requirement is not necessary.
