Preliminary comments for the following divisions of the Department of Community Development and other agencies, as applicable, are attached: Albemarle County Division of Zoning & Current Development (Planner) Albemarle County Division of Zoning & Current Development (Engineer) Albemarle County Division of Planning (Development Area Planner) Albemarle County Division of Inspections (Building Official) Virginia Department of Transportation (VDOT). Albemarle County Service Authority (ACSA). Albemarle County Fire and Rescue Comments reflect information available at the time the development proposal was reviewed, and should not be considered final. However, the Site Review Committee has attempted to identify all issues that could affect approval of the proposed project. Please make the revisions that have been identified as necessary for preliminary approval by the Site Review Committee. If you choose not to make the requested revisions, please submit in writing justification for not incorporating such revisions. Submit eight (8) full size copies and one (1) 11" x 17" copy to the Department of Community Development including responses to each of the attached comments of the Site Review Committee by Monday, November 16"', 2009.. Failure to submit this information by this date will result in suspension of the review schedule. Review will resume when revisions are submitted along with a reinstatement fee of $65. [14- 302.(A).2] Vicinity map. A map at a scale of one (1) inch equal to two thousand (2,000) feet showing the property and its relationship with adjoining land and streets, its relationship with landmarks in the area and, if the subdivision is a phased subdivision, all other phases of the subdivision for which a final plat has been approved, in detail adequate to describe the location of the property without field review. Please provide a vicinity map at a scale of one (1) inch equal to two thousand (2,000) feet. 2. [14- 303.N] Statement pertaining to private streets. If the subdivision will contain one or more private streets, the following statement: The proposed subdivision will contain one or more private streets. Please add the following note to the plat. "The streets in this subdivision may not meet tlae standards for acceptance into the secondary system of state highways and will not be maintained by the Virginia Department of Transportation or the County of Albemarle." 3. [14- 303.Q] Water supply. A statement as to whether the subdivision will be served by a public water supply and a public sewer system. If the property is not within the service authority jurisdictional area, the following statement: "Under current county policy, public water and /or sewer service will not be available to this property." Please add a note to the plat as to whether the subdivision will be served by a public water supply and apublic sewer system. Our records indicate that this area is within the jurisdictional area served by public water and sewer. Please add a note to this effect on the plat. 4. Control points. At least four (4) control points, evenly distributed across the property and located at survey property corners, and shown on each sheet depicting the property. At the option of the subdivider, the control points may be shown on 'a copy of the final plat, rather than on the original final plat. Please add on to the final plat or on a copy of the final plat, at least 4 control points evenly distributed across the property. 5. The Equestrian Center is only required to have 38 acres.. I do not believe that having more acreage is problematic; however, if this ends up being an issue, please consult Zoning. The plat should contain language ensuring that the area is available for common use by the residents of Glenmore. The proposed plat is in keeping with the existing Land Use Plan. Box 7623 Charlottesville, VA 22906 Re: Glenmore Associates Equestrian Final Plat (SUB 2009 -147) — Condition of Plat Approval to Satisfy Rezoning Proffer Relating to Signal at Route 250 (ZMA 99- 16) Dear Mr. Gaffney, This letter is in follow -up to our letter to you dated September 11, 2009. We have received your proposed construction schedule which shows completion of the signalization by March 1, 2010. This completion date is later than our expected date of December 31, 2009. The Glenmore Associates Equestrian Final Plat (SUB 2009 -147) is pending County approval at this time. Because Glenmore Associates has not satisfied proffer #8 of ZMA 99 -16 requiring installation of the traffic signal at the entrance to Glenmore on Route 250, we could begin a more formal enforcement process, including withholding approvals. Virginia Code Section 15.2 -2299 provides: "Failure to meet all conditions shall constitute cause to deny the issuance of any of the required use, occupancy, or building permits as may be appropriate." After consultation with the Director of Community Development and the Deputy County Attorney, we have decided not to withhold the approval of this pending plat. Instead, we will condition the final plat approval (signature) on the establishment of a bank account with the necessary funds to cover the installation of the traffic signal. Please provide a copy of the construction estimate as the basis for the necessary account balance. This account will need to be set up giving Mark Graham, Director of Community Development, the ability to authorize payment to the contractor for the completed work on the traffic signal construction. Please let us know which bank will handle this account and who the point -of- contact is at the bank, so we can discuss it further with the bank if necessary.
