SUBJECT: Zoning Clearance CLE2009 -199, Superfun Arena at Fashion Square Mall
Mr. Bell,
Our office has received the above referenced application requesting to operate Superfun Arena.
The application states that this use is to provide play attractions for children. The use as you
have described meets the definition of a commercial recreation establishment, which is allowed
only by special use permit in the Planned Development- Shopping Center zoning district. Also,
you have stated that the intent is to operate the use for the holiday season. Please be advised that
this use can be allowed only as a seasonal /temporary use at this location. Based on the
information you have provided, including the copy of the signed lease which provides the lease
end date of December 31, 2009, this clearance can be approved with the condition that the use
ceases as of December 31, 2009. Should you decide to pursue the use on a permanent basis, we
urge you to contact this office as soon as possible to arrange a pre- application conference to
discuss the route necessary to obtain such approval.
