Subject: SDP 2009 —101 Rivanna Commercial Park - Prelim
You have asked me for an opinion regarding the requirement for access to the adjoining parcel. The
provision that permits the requirement of access to adjoining parcels states:
32.7.2.5 The commission or the agent may require provision for and /or construction of travel lanes or
driveways to serve adjoining properties. The pavement of vehicular travel lanes or driveways
designed to permit vehicular travel on the site and from adjacent property and parking areas shall
be not less than twenty (20) feet in width.
This property is subject to proffers, reference ZMA 87 -19. In particular proffer 4 states "We proffer to
restrict the development of the property to the general outline of the master plan which has been
submitted as part of this rezoning application." The master plan submitted as part of the rezoning
application does not show a connection to the adjacent property.
Based on the fact that the master plan does not show a connection to adjacent property I do not believe
that we should require a connection. I believe we should encourage the applicant to consider a connection
and support any efforts to provide inter - parcel connectivity. However, failure to provide inter - parcel
connection will not result in denial of the site plan.
