DEED OF GIFT
THIS DEED OF GIFT, made and entered into on this day of .
February, 2010, by and between TIMOTHY W. WYANT, the Grantor, and ANGIE M.
BRITTON, the Grantee, whose address is 5440 Break Heart Road, Crozet, Virginia
22932,
WITNESSETH:
That for and in consideration of the natural love and affection the Grantor bears
for the Grantee, the Grantor hereby gives, grants, and conveys with GENERAL
WARRANTY and ENGLISH COVENANTS OF TITLE unto.the Grantee, as her sole
and separate equitable estate free from the control and marital rights of any present or
future husband and free from any dower rights or inchoate rights of any present or future
husband of the Grantee, all of which are hereby expressly excluded, the following
described real estate (the "Property "), to -wit:
ALL that certain parcel of land; with improvements thereon and
appurtenances thereunto pertaining, situated in Albemarle County,
Virginia, on the north side of Old Breakhart Road, containing 2.5329
acres, more or less, as shown as Parcel `B" on a plat by Harrison Surveys,
dated April 19, 2008, and recorded in the Clerk's Office of the Circuit
Court of the County of Albemarle, Virginia, in Deed Book 3850, page 1
(the "Plat ");

BEING a portion of the property conveyed to the Grantor by Earline B.
Wyant by Deed of Gift dated October 13, 1989 and recorded in the
aforesaid Clerk's Office in Deed Book 1072, page 493.
This conveyance is made expressly subject to the restrictions contained in § 14-
212(B) of the Albemarle County Code, and as such, the Property may not be transferred,
except by devise, descent or operation of law, to a person other than an eligible member
of the immediate family of the Grantor, for a period of four, (4) years after February 16,
2010, except for the purposes of securing any purchase -money and /or construction loan,
including bona fide refinancing, or if the lending institution requires in writing that the
spouse of the member of the immediate family be a co- grantee and co -owner of the
Property. If the Property is conveyed back to the Grantor during the such four year
period, it shall be recombined with Parcel "A" as shown on the Plat within six (6) months
after such conveyance and no building permits shall be issued for Parcel "A" or Parcel
"B" until they are recombined.
This conveyance is further subject to any easements, restrictions, and reservations
contained in duly recorded deeds, plats, and other instruments constituting constructive
notice in the chain of title, which have not expired by a time limitation contained therein
or have otherwise become ineffective, and to matters visible upon inspection.
