We reviewed this proposal in our A -team meeting this past Tuesday and concluded that it is exempt from our critical slopes regulations. It is exempt based on the fact that the proposed activity: a) Does not require the issuance of a building permit; b) Does not require a site plan; and c) Does not require subdivision of the property; Please let me know if any of these presumptions are incorrect or if you think I'm not considering something. As you know and see by the reference below, the regulations of Section 4.2 apply to structures and improvements for which a bldg permit is required. 4.2.3 LOCATION OF STRUCTURES AND IMPROVEMENTS (Amended 11- 15 -89) Except as otherwise permitted pursuant to section 4.2.2, the provisions of this section shall apply to the location of any structure for which a permit is required under the Uniform Statewide Building Code and to any improvement shown on a site development plan pursuant to section 32.0 of this chapter.
