County Code 14- 303(A) and (0) require the signatures of all "owners, proprietors and trustees" and this language
matches state law (Virginia Code 15.2- 2264). We don't require title reports to determine who has ownership interests
in property being subdivided, so we leave it up to the subdivider to assure that all of the necessary consents are included
on the plat. The subdivider is, in effect, proceeding at its own risk if it fails to obtain all required signatures. Based on
County Code 14- 303(A) and (0), combined with our knowledge that there is a deed of trust with one or more trustees on
the Ja -Zan parcel, the answer to your question is "yes," the trustee needs to consent to the subdivision. Obtaining the
signature of the trustee is in March Mountain's and Ja -Zan's best interests as well. If the deed of trust has language
similar to the language I've seen in other deeds of trust, the landowner will be in default if any interest in the property,
including any easement, is created without the trustee's consent.

I have a plat here for Old Trail where there is a private street going through an adjacent property and owner. March
Mountain owns the property being subdivided, and Ja -Zan LLC owns the property adjacent that the private street is going
through for access. I have told the applicant that Ja -Zan needs to sign the plat as well as March Mountain, however they
have this question below that I cannot answer. Can you let me know if the trustee needs to sign as well? Let me know if
you want to see a copy of the plat.
