No access is provided between the proposed parking area and the existing dealership. Both vehicular and pedestrian access must be provided. The ordinance requires inter - parcel connection with the following provisions: 4.12.8 ALTERNATIVES AVAILABLE TO PROVIDE MINIMUM NUMBER OF PARKING SPACES c. Provision of means for safe movement. Sidewalks and other means for permitting safe movement of pedestrians between the parking area or spaces and the use or structure they serve shall be provided. d. Parking not to be separated from use by major roads. No parking area or spaces shall be separated from the use or structure they serve by a street whose classification is greater than a major collector, unless safe and convenient access is provided from the parking area or spaces to the use or structure and is approved by the director of planning and community development. Potentially the sidewalk system on Route 250 could be seen as providing pedestrian access. The above provisions are not modifiable. The applicant appears to be proposing to use the area "as is ". This area does not meet the minimum standards for a parking area as contained in 4.12.15, 4.12.16, and 4.12.17. The applicant may request a waiver of these standards by following the procedures outlined in 4.12.2(c). Specifically the applicant should submit information to allow the Zoning Administrator to find "that the public health, safety or welfare would be equally or better served by the modification or waiver and that the modification or waiver would not otherwise be contrary to the purpose and intent of this chapter ". A site plan is required for this use [reference 4.12.11(a)]. Please make sure that the applicant is aware that if the special use permit is approved that a site plan must still be approved prior to using the area for parking.
