Marotta, Senior Planner Re: SUB2010 -43 Patterson Family Division The Zoning and Current Development Division of the Albemarle County Department of Community Development will approve the proposed plat referred to above when the following items have been satisfactorily addressed. (The following comments are those that have been identified at this time. Additional comments or conditions may be added or eliminated bases upon further review.) Each comment is preceded by the applicable reference to the Albemarle County Code. 1. [14- 302A.1] Name of subdivision. COMMENT: The title claims a new 40' private street easement, however only 30' is drawn on the plat. Please resolve this discrepancy. 2. [ 14 -302A. I I ] Instrument creating property proposed for subdivision. COMMENT: In Note #2, DB is followed by a blank space. Please address this. 3. [14- 302A.15, 14 -211, 14 -212] Identification of all owners, Verification of family division. COMMENT: Before this plat can be approved, you must provide evidence of compliance with these sections of the code that relate to ownership and verification of family division. a. Please ensure that the subdivider has not previously divided any other land in the county by family subdivision for transfer by sale or gift to the same family member(s). [14-21 1B] b. Please provide evidence that ownership complies with 14 -212A, which states: No lot may be created by family division unless it has been owned by the current owner or a member of his or her immediate family for at least four (4) consecutive years immediately preceding the date the family division plat is submitted under section 14 -210. c. Please provide copy of affidavit, deed, letter from attorney stating: grantee, grantor and their relationship; and certifying that this is a Family Division in accordance with Section 14 -208 and related provisions of the Albemarle County Code. d. Please provide draft of restrictive covenant, as required by 14 -212B, for review and acceptance by the County Attorney. 4. [14-302B. 10] Stream Buffers note. COMMENT: County GIS shows a small stream buffer in the area of the 0.09 acre boundary overlap (southwest corner of property). Please address this discrepancy. 5. [14 -309, 14 -3101 Soil evaluations, Health Director approval. COMMENT: Please submit soils work, or evidence of approved drainfields.
