Marotta, Senior Planner Division: Zoning & Current Development Date: May 18, 2010 Subject: SDP - 2010 -22 Hollymeade Town Center Apartments The Planner for the Zoning & Current Development Division of the Albemarle County Department Community Development will recommend approval of the plan referred to above when the following items have been satisfactorily addressed. (The following comments are those that have been identified at this time. Additional comments or conditions may be added or eliminated based on further review.) [Each comment is preceded by the applicable reference to the Albemarle County Code.] [32.5.6.a] COMMENT: This site plan is subject to ZMA1992 -14 and SP 1992 -14. You must note on the plan that the R -15 zoning is subject to ZMA1992 -14 and SP 1992 -14 and you must list all conditions and proffers on the plan. UPDATE: The proffers you copied onto the cover sheet are incorrect. I have attached a copy of the Board of Supervisor meeting minutes so you can copy the correct proffers onto the plan. ZMA 1992 -14, (the correct) Proffer #1 states that the approved mobile home park is proffered for a period of 15 years and that no other R -15 uses may be started on the property until 15 years from the date of the first building permit. The first building permit was issued on 5/6/1997, therefore the first building permit for this apartment project may not be issued until 5 /6/2012. Please be on notice that approval of this preliminary, the critical slopes waiver, and the final site plan in no way invalidates the conditions of ZMA1992 -14. 5. [32.5.6.a] COMMENT UPDATE: Please be aware that prior to Final site plan approval, Albemarle County must sign off on the affordable housing proposed for density bonuses and all necessary documents must be provided pursuant to applicable sections of the code. 7. [32.5.6.a] COMMENT UPDATE: Please note that prior to final site plan approval you must demonstrate that the "wooded area" for which you are claiming a density bonus meets the definition provided in Section 18 -3.1 "wooded area." A signed letter from an arborist and a Conservation Plan will be required. With adjustments to the clearing limits that may be required for E &S and critical slopes waiver approval (pending), the limits of the preserved wooded areas may be altered. 8. [32.5.6.n] COMMENT UPDATE: You must provide recreation amenities in conformance with the code requirements, or a Request for Substitution must be approved. Per my 5/14/10 letter to you, we did not approve your 4/26/10 substitution request, and as proposed the plan is not in conformance with the code. 9. [32.5.6.c] COMMENT: Please provide more information about proposed phasing, including phase lines on the plans, and planned timing of installation of amenities. Staff must be able to determine if applicable requirements can be met with each proposed phase. UPDATE: As you revise recreational amenities, please be sure to meet phasing requirements. 2 Final tentative approval from this department will be subject to the following conditions: [These conditions are those which have been identified at this time. Conditions may be added or eliminated based on additional review.] A conservation plan and signed letter from an arborist will be required to demonstrate that the "wooded area" for which you are claiming a density bonus meets the definition provided in Section 18 -3.1 "wooded area." Town Center Drive must be dedicated prior to final site plan approval. 5. Approval of critical slopes waiver. (This is tentatively scheduled to go the Planning Commission June 8, 2010.)
