The Department of Community Development hereby grants conditional administrative approval to the
above referenced site plan.
The approval of the preliminary site plan is valid for (1) one year in accordance with Section 32.4.3.1 of
Chapter 18 of the Albemarle County Code. Therefore, the preliminary approval shall expire on June 15,
2011. If the preliminary site plan approval expires, a new application must be filed and processed.
Please address all of the requirements and conditions listed below and submit eight (8) tentative plan
copies to the Department of Community Development. This letter must be submitted with the tentative
plans, as a checklist, to document that you have addressed all requirements or conditions, or the tentative
plan will be denied.
Erosion and Sediment Control, BMP Stormwater Management, and road plans with the associated
applications and fees must also be submitted with the eight (8) tentative Plans.
Once the tentative plan is submitted and reviewed you will receive comments from all
departments /divisions /agencies that have made comment on the tentative plan. Any further
responses must be made directly to each department/division /agency that has further comment.
After all aforementioned departments /divisions /agencies have granted a tentative approval, you
must verify with the Planner that you may submit the final mylars (2 sets), two paper copies, the
final site plan application, and final site plan fee to the Department of Community Development.
Signing of the plans will occur within one week once it is determined that the final site plan mylars
reflect all tentative approvals.
The final site plan will be subject to all final site plan requirements (Zoning Ordinance Section 32.6), in
addition to the following conditions.
The Department of Community Development shall not accept submittal of the final site plan for signature
until tentative approvals for the following conditions have been obtained:

Town Center Apartments- Preliminary Site Plan

Zoning & Current Development approval to include:
1. [SECTION NUMBER] COMMENT: [32.5.6.a] This site plan is subject to ZMA1992 -14 and SP
1992 -14. You must list all conditions and proffers on the plan. You have provided them on the
plan, but for clarity, just provide the proffers themselves; the extra minutes from the Board of
Supervisors meeting are unnecessary and make it difficult for the average reader to readily pick
out what the proffers are.
2. [ZMA 1992 -14] Proffer #1 states that the approved mobile home park is proffered for a period of
15 years and that no other R -15 uses may be started on the property until 15 years from the date
of the first building permit. The first building permit was issued on 5/6/1997, therefore the first
building permit for this apartment project may not be issued until 5 /6/2012. Please be on notice
that approval of this preliminary, the critical slopes waiver, and the final site plan in no way
invalidates the conditions of ZMA1992 -14.
3. [32.5.6.a] Prior to Final site plan approval, Albemarle County must sign off on the affordable
housing proposed for density bonuses and all necessary documents must be provided pursuant to
applicable sections of the code. To begin the process, and for questions as to what documents will
be required, please contact Scott White with Albemarle County Housing, at 434 - 296 -5839.
4. [32.5.6.a] Prior to final site plan approval you must demonstrate that the "wooded area" for which
you are claiming a density bonus meets the definition provided in Section 18 -3.1 "wooded area."
A signed letter from an arborist and a Conservation Plan will be required. With adjustments to the
clearing limits that may be required for E &S, the limits of the preserved wooded areas may
change.
5. Clarify how, in the southeastern-most parking lot, the drive aisle between the 2 parking banks
will be treated between Phases I and 2. Will this drive aisle serve as 2 temporary parking spots,
or, be held as a drive aisle that dead ends? Provide more detail on the plan.
6. Town Center Drive must be dedicated prior to final site plan approval.
Engineering approval to include:
❑ The plan must meet all engineering requirements of the Water Protection, Subdivision, and
Zoning Ordinances in addition to all engineering standards detailed in the County's Design
Manual.
❑ A Traffic Impact Analysis (per VDOT Chapter 527) must be prepared and submitted with the
plan.
❑ Tree Preservation areas should be staked in the field and protected with measures described in the
VESCH. County staff should field verify protected areas prior to the issuance of a grading
permit.

Fire & Rescue approval to include:
❑ COMMENT: Must comply with the Virginia Statewide Fire Prevention Code. Verify
adequate fire flow is available. Final approval is subject to field inspection and
verification.

❑ The traffic generated by the proposed site plan meets the threshold for Chapter 527
