The Zoning and Current Development Division of the Albemarle County Department of Community Development
will recommend approval of the proposed easement plat referred to above when the following items have been
satisfactorily addressed. (The following comments are those that have been identified at this time. Additional
comments or conditions may be added or eliminated bases upon further review.) Each comment is preceded by the
applicable reference to the Albemarle County Code.
1. [Sec. 14- 302A2] Vicinity map. COMMENT: Map must be at a scale of 1:2000.
2. [Sec. 14- 302A3] Existing streets. COMMENT: Add state route number for Berkmar Drive.
3. [Sec. 14- 302A4] Private easements. COMMENT: Declaration of Covenants (recorded 3- 14 -97) are
sufficient to indicate a shared parking /access agreement is in place for lots 2, 3, and now 4. The agreement
stipulates that areas are designated as "parking area or parking easement" on land that was part of parent lot
2 (and all lots subdivided from lot 2) are also subject to nonexclusive automobile parking uses.
In order to be consistent with the agreement, please show the limits of the parking and ingress /egress
easement to be the extent of all automobile parking /ingress /egress, and make a note on the plat that the
easement proposed is subject to the covenants as recorded /amended in Db 1600 PG 447 *.
*I noticed that on the proposed plat, the DB referenced for the parking easement between lots 2 and 3 says
DB 1710 PG 501. Please make sure that the instrument referenced for the proposed easement(s) is the most
current, accurate one. Is DB 1710 PG 501 an amended version of DB 1600 PG447? (Possibly recorded
when lot 3 was platted ? ?) You may want to consider updating the agreement and recording it with this plat.
4. [Sec. 14- 302A91 Building sites on proposed lots. COMMENT: Provide note required by this section.
5. [Sec. 14- 302A15,3030] Identification of all owners, signature panels. COMMENT: Provide name and
title of person signing on behalf of Loupe, LLC.
6. [Sec. 14- 302131] General information. COMMMENT: Please provide a graphic scale on the plan.
7. [Sec. 14 -30213] Reservoir watershed/agricultural forestal districts. COMMENT: Provide notes as
required by this section.
8. [Sec. 14- 302138] Yards. COMMENT: While not required for approval, it is helpful to add the required
setbacks as a note (in addition to showing them) on the plat.
9. [Sec. 14- 302B9] Flood plain. COMMENT: Provide note as required by this section.
10. [Sec. 14 -3030] Signature panels. COMMENT: Planning Commission signature panel maybe removed; it
is not applicable for this plat.
11. [Sec. 14 -303Q] COMMENT: Provide note as required by this section.
12. [Sec. 14 -303S] Control points. COMMENT: Control points must be submitted. This may be done on a
separate exhibit.
