Re: SUB200900101 Feiner 2 -Lot and 404 Waiver
The Zoning and Current Development Division of the Albemarle County Department of Community Development
will recommend approval of the proposed easement plat referred to above when the following items have been
satisfactorily addressed. (The following comments are those that have been identified at this time. Additional
comments or conditions may be added or eliminated bases upon further review.) Each comment is preceded by the
applicable reference to the Albemarle County Code.
1. [Sec. 14- 302A2] Vicinity map. COMMENT: The ordinance requires the vicinity map be provided at a
scale of 1 "=2000'. Please revise. UPDATE: Please add a scale to the map.
2. [Sec. 14- 302A4-91 Building sites on proposed lots. COMMENT: Please provide required note verbatim
per this section. UPDATE: I made an error noting the applicable section. Please remove Note #21 and
replace it with the note required by Section 14- 302A9.
3. [Sec. 14 -303S] Control points. COMMENT: Provide control points; this maybe done on a separate sheet.
UPDATE: Your comment response letter indicated control points were submitted on a separate sheet,
however I did not find it in the package submitted. Please submit control points again. You may do this via
pdf and email if you wish.
4. [Sec. 14 -310] Health Director approval. COMMENT: Health Department approval is required prior to
approval of this plat. UPDATE: The revised plat and soils work were been forwarded to the Health
Department for review.
5. [Sec. 14 -404] Lot location to allow access from lot onto street or shared driveway. COMMENT: This
plat requires a waiver of Section 14 -404. The plat cannot be approved without VDOT approval and
Planning Commission approval of the waiver. The plat has been forwarded to VDOT for review, and your
A -1;17 - request has been received and is scheduled to go to the Planning Commission September 22, 2009.
UPDATE: [Sec. 14 -404C] Since the time you made your original application, the Albemarle County Code
has been amended. Because two (2) dwellings existed on the subject parcel before October 14, 2009, you
are exempt from the requirements of 14 -404, and your proposal no longer requires a waiver. VDOT
approval of the entrance is still required, however.
