Section 15.2-2284 of the Code of Virginia states that, "Zoning ordinances and districts shall be drawn and applied
with reasonable consideration for the existing use and character of property, the comprehensive plan, the suitability
of property for various uses, the trends of growth or change, the current and future requirements of the community
as to land for various purposes as determined by population and economic studies and other studies, the
transportation requirements of the community, the requirements for airports, housing, schools, parks, playgrounds,
recreation areas and other public services, the conservation of natural resources, the preservation of flood plains,
the preservation of agricultural and forestal land, the conservation of properties and their values and the
encouragement of the most appropriate use of land throughout the locality."

Proffers are voluntary offers to use property in a more restrictive way than the overall zoning district
classification would allow. By State Code, proffers must have a reasonable relationship to the rezoning and are
not mandatory. The rezoning must give rise to the need for the proffers; the proffers must be related to the
physical development or physical operation of the property; and the proffers must be in conformity with the
Comprehensive Plan.

Although a full TIA is not required to be submitted, the expected traffic to be generated
by a potential use on this property needs to be provided, for review by the
Transportation Planning division.
Additional Information
• The Places29 Master Plan identifies most of this parcel as "Urban Mixed Use in Centers," which recommends a
mix of residential, commercial, and service uses. Small portions of this parcel are designated as "Neighborhood
Density Residential" and "Office/R&D/Flex/Light Industrial."
• Consider which uses permitted by -right in the HC zoning district may not be appropriate or recommended for
the Urban Mixed Use in Centers land use designation.
• The surrounding area to the north is residential. Consider impacts, and mitigation of such impacts, on these
areas.
• There are plans by VDOT and the County for a round -about to be constructed at the intersection of Airport Road
and Lewis & Clark Drive as a part of the Berkmar Dr. extension project. This intersection work will likely have an
impact on this parcel. It is recommended to contact VDOT to discuss the plans for this area.
• Consider bike and pedestrian infrastructure in this area.
• The subject property is located within the Entrance Corridor overlay district.
o The ordinance requirements for this overlay district will apply to this project.
o Review by the ARB will be required. Contact Margaret Maliszewski with any questions
(mmaliszewski@albemarle.ore).
• This property is also located within the Airport Impact Area overlay district.
• Consider stormwater management requirements.

• Because it is in an entrance corridor, consider the requirements for any potential retaining walls, such as height
and terracing requirements.
• These properties are in the ACSA jurisdictional area and will be required to connect to public water and sewer.
Consider these connections when planning the site. Any questions about public utilities should be directed to

• Consider emergency access to this development. Appropriate fire flow will be required. Any questions about
