The Zoning and Current Development Division of the Albemarle County Department of Community
Development will recommend approval of the proposed easement plat referred to above when the
following items have been satisfactorily addressed. (The following comments are those that have been
identified at this time. Additional comments or conditions may be added or eliminated bases upon further
review.) Each comment is preceded by the applicable reference to the Albemarle County Code.
[Sec. 14- 302A31 Existing or platted streets. COMMENT: Please note instrument for existing
30' access easement.
2. [Sec. 14- 302.A.I I] Instrument creating property proposed for subdivision. COMMENT: It
appears the DB reference is 1606, not 10606. Please address.
3. [Sec. 14- 302.13.5] Zoning classification. COMMENT: This property is also in the Entrance
Corridor Overlay District. Please edit zoning note accordingly.
4. [Sec. 14- 302.13.6] Tax map and parcel number. COMMENT: On Sheet 2, please confirm TMP
is correct on the plat; County GIS indicates the subject parcel and adjacent parcel to the south are
known by other TMP #s (1 OA 1 and 1 OA, not l OA and l OB )
5. [Sec. 14- 302.13.8] Yards. COMMENT: Reorient your setbacks so that the front yard is adjacent
to the private street upon which is it getting frontage. Additionally, the front setback along an
internal private street is 25', not 75'.
6. [Sec. 14- 303.L] Public utility, drainage, and sight distance easements. COMMENT: VDOT
must approve the new proposed easement entrance, even though there are driveways there now.
As part of this, they must confirm no additional sight distance easements are needed.
7. [Sec. 14-234.E] COMMENT: If you wish to plat a new access easement over the existing
driveway entrance onto the public street, you must abandon the current entrance with this plat.
8. [Sec. 14 -211 and 212.A.] COMMENT: Verification of Family Division is required, in
accordance with this section.
9. [Sec. 14- 212.C., 316] COMMENT: VDOT must approve the new proposed entrance easement;
please work with VDOT to gain approval, and provide evidence of approval to me.
10. [Sec. 14- 308.1] Groundwater assessment information. COMMENT: groundwater study is
required, please provide required fee ($ 330.00) and staff will prepare the report and return a copy
to you.
11. [Sec. 14 -309, 310, 416] Health Director approval required. COMMENT: Submit 3 sets of soils
work for each lot (lot 3 and 4) to me. I will forward copies to the health department for review. If
you have existing health department approval showing the primary and reserve drainfields for the
proposed lot 3 will remain on lot 3, you may submit that in lieu of soils work for lot 3.
12. [Sec. 14 -312] Location of existing buildings. COMMENT: Please provide dimensions from
existing structures to the property line.
13. [Sec. 14- 212.B] Restrictive covenant. COMMENT: Per this section, submit draft of restrictive
covenant to me. I will review and forward to County Attorney for his review.
