The County of Albemarle Division of Zoning and Current Development will grant or recommend approval of
the final plat referenced above once the following comments have been addressed: [Each comment is preceded
by the applicable reference, which is to the Subdivision/Zoning Ordinances unless otherwise specified.]
1. [14- 302(A)141 Land to be dedicated in fee or reserved. The location, acreage, and current owner of all land
intended to be dedicated in fee or reserved for public use, or to be reserved in a deed for the common use of
lot owners in the subdivision. Open space parcel C (1.081 acres) is to be dedicated and conveyed to
Albemarle County with this subdivision plat. Additionally Open Space Parcel A (1.182acres) is to be
dedicated and conveyed with this subdivision plat. Please change the language on the plat to read as follows:
Open Space Parcel "A" 1.182 AC hereby dedicated to Albemarle County. Similarly, Open Space Parcel "C"
1.081 AC hereby dedicated to Albemarle County. Please refer to Proffer 3.2 and 3.3 Associated with ZMA
2006 -001 Westhall — Phase V. Open Space A and C shall be dedicated and conveyed in fee - simple.
2. [14- 302(b) 7] Reservoir watershed; agricultural forestal district. A notation as to whether the land is within
an Albemarle County and/or City of Charlottesville water supply watershed or an agricultural - forestal
district. Please change note 3 on the plat to read as follows: "This site is within the Lickinghole Creek Water
Supply Watershed. The site is not in an Agricultural — Forestal district ".
3. 14 -303.G Ownership of Common Areas: Open Space parcel `B" is to be maintained by the Westhall
Community Association and not Westall Community Association. Please correct the note on the plat (page
3 of 5).
4. [14- 303.0] Statement pertaining to private streets. If the subdivision will contain one or more _private streets,
the following statement: "The streets in this subdivision may not meet the standards for acceptance into the
secondary system of state highways and will not be maintained by the Virginia Department of
Transportation or the County of Albemarle." Please add the above statement (Verbatim) to the plat.
5. [14- 303(s)] Control points. At least four (4) control points, evenly distributed across the property and
located at survey property corners, and shown on each sheet depicting the property. At the option of the
subdivider, the control points may be shown on a copy of the final plat, rather than on the original final _plat.
Add control points to the plat.
6. [14 -317] if the subdivision will contain one (1) or more improvements that are not to be maintained by the
county or any authority or other public agency, the subdivider shall submit with the final plat an instrument
assuring the perpetual maintenance of the improvement. The instrument shall be subject to review and
approval by the county attorney and shall be in a form and style so that it may be recorded in the office of
the clerk of the circuit court of the county. The agent may require that the instrument be on a form prepared
by the county attorney. Submit a road maintenance agreement for Rella Court that shall be subject to review
and approval by the county attorney. As stated above, the road maintenance agreement shall be in a form
and style so that it may be recorded in the office of the clerk of the circuit court.
7. 14 -431 Easements for facilities for stormwater management and drainage control. Deeds are required
for all drainage easements dedicated to public use.
8. 14 -435 Surety in lieu of completion of on -site improvements. This plat cannot be signed by the County
until road and ESC bonds are posted. Please coordinate with Philip Custer (Current Development Engineer)
to get the ESC and road bonds posted. What does the note 1.486 Acres hereby dedicated for road
improvement mean? Summerdean road is to be dedicated to public use (hereby dedicated). Is that what the
note implies? Please clarify or revise the note on the plat.
Proffers Associated with ZMA 2006 -001 Westhall — Phase V:
Open Space and Greenways:
3? Trailhead Park: The Owner shall dedicate and convey in fee - simple to Albemarle
County, Open Space, Parcel A, or " Trailhead Park" as shown on the application plan with the
first subdivision plat and grant drainage easements in a form approved by the County
Attorney. In conjunction with improvements approved with the first subdivision plat, the
Owner shall construct a 6' asphalt trail consisting of four (4) inches of 21 -B stonebase
material and two (2) inches of SMA -2 asphalt or other specifications approved by the County
Engineer. The trail shall connect five parking spaces to the greenway system, a 2100 +/-
square foot tot lot with a 42" fence, a stormwater management facility and landscaping.
The stormwater management facility shall be designed such that its shape, placement, and
land form (grading) transition between the adjacent residential lots, the tot lot on the site, and
the trailhead elements, to the satisfaction of the Department of Parks and Recreation. The tot
lot shall contain the following elements: a play structure, a small swing set and a set of two
spring mounted riding figures, or other elements approved by the Director of Planning.
Open space areas dedicated to public use shall be for the use and enjoyment of the public,
including the residents of the project.
3.3 Open Space: The Owner shall dedicate and convey to Albemarle County, Open
Space, Parcel C, as shown on the application plan with the first subdivision plat and grant
drainage easements in a form approved by the County Attorney. The Owner shall construct a
6' asphalt trail consisting of four (4) inches of 21 -B stonebase material and two (2) inches of
SMA -2 asphalt or other specifications approved by the County Engineer and a stormwater
management facility. The stormwater management facility shall be designed such that its
shape, placement, and land form (grading) transition between the adjacent street, greenway,
and trails to the satisfaction of the Department of Parks and Recreation and minimize
disturbance of the stream buffer within Parcel C shown on the Application Plan to the
satisfaction of the Program Authority. Open space areas dedicated to public use shall be for
the use and enjoyment of the public, including the residents of the project. The Owner shall
make a contribution of $3,000 to the County to be used by the Parks and Recreation
Department for the construction of a pedestrian bridge in the general location shown on the
Application Plan. The contribution shall be payable prior to issuance of the first building
permit for the property. If the bridge is not constructed within 10 (ten) years of rezoning
approval of the property, the contribution shall be reallocated to the County's Capital
Improvement Program for park improvements for the community of Crozet.
The above proffers (3.2 and 3.3) need to be satisfied before final plat approval can be granted.
